Subject: Closure & Conveyance of the Road Allow-
ance between Lots 6 & 7, Concession 4,
former Township of Darlington.
Recommendation:
THAT the Appraised Value of the land comprising the road allow-
ance between Lots 6 & 7, Concession 4, former Township of
Darlington, be established at $1,200. 00 (Twelve Hundred Dollars)
per acre and, further, that subject to Easements being granted
to TransCanada Pipelines Limited over Parts 2 & 7, and to Inter-
provincial Pipe Line Limited over Parts 3 & 8, Parts 1 to 9 of
Reference Plan IOR-1250 be closed and conveyed to the abutting
owners, in accordance with Town Policy.
Report:
Following a request from Mr. & Mrs. J. Higginson, Public Works
Committee, by Resolution # W-192-80, agreed to close and convey
the road allowance abutting their property located in Lots 6 &
7, Concession 4, former Township of Darlington.
Upon the acquisition of a Reference Plan (10R-1250) it was found
that there are two pipeline crossings over the road allowance in
question and, thus, the Companies involved were contacted for
their comments relative to the proposed disposal of the road
allowance.
Both Interprovincial Pipe Line Limited and TransCanada Pipelines
acknowledged and agreed to the proposal and, with their replies,
enclosed standard pipeline crossing Agreements in order that
their rights-of-way over the road allowance would be protected.
(These, or similar, Agreements are already in force in respect
of privately-owned lands adjoining the subject road allowance) .
The abutting owner to the south of the road allowance is the
Central Lake Ontario Conservation Authority, which has indicated
it's concurrence with the closure and conveyance, by Resolution

No. 69, as follows:
"THAT the Authority approve of the conveyance of
Parts 6, 7, 8 & 9, Plan 1OR-1250 at nominal cost.
THAT the Authority adopt a project to acquire the
abutting road allowance from the Town of Newcastle
to increase the Authority's holdings at the
Stephen's Gulch Conservation Area;
THAT the Authority request the approval of the
Minister for this project, and that a grant in the
amount of 55% of the total cost be requested;
AND FURTHER, that the Regional Municipality of
Durham be levied the Authority's share of the cost".
The actual value of the Parts to which the abutting owners are
entitled are as follows:
Parts 1, 2, 3 & 4 $705. 00 (Locke)
Part 5 $1,050. 00 Hi

It is suggested that this matter can now be drawn to a con-
clusion, in accordance with the foregoing, and the Town may
execute the Pipeline Crossing Agreements with the appropriate
companies, and dispose of the road allowance between Lots 6 &
7, Concession 4, former Darlington, more particularly defined
on Plan IOR-1250, in accordance with Town Policy and procedure.
