Subject: Request for Encroachment
Parts 10 & 11, Plan IOR-1272.
(Division Street, Bowmanville) .
Recommendation:
THAT, subject to the adoption of the Policy for Encroachment by
Council, the request be granted, in accordance with Item 4(ii) (a)&(d)
of the Solicitor's letter accompanying Report # WD-57-81 in the
Public Works Committee Agenda for April 14, 1981.
Report:
A request has recently been received, from the Solicitors for
F.F. Morris Funeral Chapel Limited, that formal permission be
granted in respect of an existing encroachment onto Division
Street in Bowmanville.
As will be seen from the attached Reference Plan, 1OR-1272, the
encroachments consist of the Funeral Chapel, by 6.50 feet. , and
the adjacent dwelling by 3.0 feet. By reason of the fact that the
situation has existed for an extensive period of time, it is felt
that permission for the requested encroachments can be granted,
for so long as the land in question is not required for Municipal
purposes
