Closure/Conveyance of the Road Allowance
between Lots 4 & 5, Concession 4, former
Township of Clarke.
Recommendation:

THAT the road allowance between Lots 4 & 5, Concession 4,
former Township of Clarke, as defined on Plan 1OR-1230, be
closed, from the 5th Concession, southerly, to the railway
right-of-way (Parts 3, 6, 7 and 8 of Plan IOR-1230) and,
further, that the appropriate by-law be presented to Council.
Report:
Item 3 of Public Works Committee Report No. 4. of the April
14, 1981, Meeting, was referred back to staff by Resolution
11 C-483-81.
Resolution 11 W-52-80 was adopted as follows:

Report WD-53-81 to the Public Works Committee of April 14, 1981,
was endorsed and contained the recommendation that, as it
appeared the majority of property owners were not in favour of
the proposal to :close and convey the total road allowance, no
further action be taken.

As a result of Council's action of April 21, 1981, Staff have

discussed the matter further with Mr. R. Westheuser, one of the
abutting owners, and he has now requested that, as the whole
road allowance cannot be closed, consideration be given to the
closure and conveyance of the allowance from Concession 5,
southerly, to the Railway right-of-way. It should be noted that
all owners whose property abuts this section of the road allow-
ance are in favour of such action.
After due consideration of this matter, it is felt that it would
be in the best interests of the Municipality to close the section
detailed above; in order to accomplish this, Plan IOR-1230 will
require amending to define the precise limits of the portion to
be closed, i.e. to terminate at the Railway right-of-way.
The relevant sections of Plan 1OR-1230 are, therefore, Part 3
(to be redefined) , Part 6, 7 and 8.
Should the recommendation contained herein be adopted, the
Town will proceed to acquire an Appraisal of Land Value, and
the matter can be finalized in accordance with Town Policy.
