Subject: Road Allowance in Lots 6 & 7, Concession 8, former Township of Darlington. Recommendation: THAT WHEREAS there were objections to the closure and conveyance of the road allowance in Lots 6 & 7, Concession 8, former Town- ship of Darlington, no further action be taken in this matter and Resolution # W-148-80 be upheld. Report: In June of 1979 a request was received, from Mr. Fred Smith, that the Town close and convey part of the road allowance between Lots 6 & 7, Concession 8, former Township of Darlington (Long Sault) . In accordance with the Town Policy in effect at that time, the Applicant paid a $100. 00 (One Hundred Dollar) deposit and the procedure of acquiring a Reference Plan and Appraisal of Land Value was undertaken. Due to the proximity of a Forced Road owned by the Regional J Municipality of Durham, that Agency was requested to indicate any interest or concern with the proposed closure; the Region replied that there was no foreseeable likelihood of their having any requirements or proposals for the relevant area, and this, too, was the position of the Town of Newcastle. This matter continued through the necessary procedure to the point of the preparation and consideration of the closing By-Law (No. 80-1) , at which time there were objections based on the premise that either the Town or the Region would realign or reconstruct the intersection of Regional Road 14 and Concession 8, Darlington. Attached is all relevant data on this matter, as was presented to the Public Works Committee of June 26, 1980. It will be seen that very considerable costs have been incurred in the process, and it is felt that there is little merit in re-opening the issue when, in all probability, the same objections to the By-Law would be raised.
