Subject: Wayside Pit Permit - Lots 5 & 6, Concession 9, former Darlington. Recommendation: THAT, subject to the Contractor (Harnden & King Construction Limited) given written agreement to the Town of Newcastle to maintain the road allowance between Lots 4 & 5, Concession 9, Darlington, in a manner satisfactory to the Town for the duration of the contract, and, further, giving written assurance that any assessed impact to the said road allowance will be corrected-to a standard approved by the Town upon the completion of the contract, authorization be given for the issuance of a Wayside Pit Permit to Harnden & King Construction Limited by the Ministry of Natural. Resources. Report: A request has been received, from Harnden & King Construction Limited, that the Town endorses the company's application for a Wayside Pit Permit in respect of the pit located in Lots 5 & 6, Concession 9, Darlington. The Ministry of Natural Resources requires the approval of the Municipality prior to the issuance of a Permit. Primarily the Contractor will use Regional Roads for the haulage of j 30,000 tons of aggregates to the site of the Liberty Street recon- struction and the only Municipal road affected will be that which is located between Lots 4' & 5, Concession 9. This road allowance is, for two-thir& of it's length, maintained by the Town, the remainder being of 'unmaintained' status. Previous practice in respect of similar matters has been that, during the contract the Contractor has assumed the responsibility for the maintainance of the Municipal road (including dust control and any requirements the Town may deem, necessary) and, upon contract com- pletion, an on-site review has determined the extent of any detrim- ental impact and the Contractor has made the necessary restorations, to the satisfaction and approval of the Town. Thus the onus of responsibility for the condition of the road(s) together with any associated costs incurred for the maintainance and restoration, are borne by others. As in other contracts, the foregoing must be by written agreement of the Contractor, prior to r commiencement of the contract. Att: Dave Oakes, Clerk Dear Sir: Re : Wayside Pit Permit (Lots 5 & 6 Concession 9, Formerly Darlington) As discussed, we are applying to the Ministry of Natural Resources for a wayside pit permit on the above property. It is the Ministry ' s policy that authorization must be received from the local municipality before such a permit may be issued. Therefore , we are requesting authorization from your Municipality to allow the Ministry to issue this permit. This pit is presently open under a wayside pit permit issued to service the M. T.C. project on highway # 401 , at that time authorization was given by your Municipality to open this source. The location of this pit has been shown on the attached map. The material from this source will service Region of Durham Contract D-81-14 awarded to Dagmar Construction. We have been issued a purchase order from Dagmar Construction to supply 30 , 000 tons of Granular "B" to this project, which was priced to come from this source . i As discussed, Dagmar Construction is planning to start construction in approximately 2 weeks time . Therefore, if this can be dealt with by Council on June lst we would greatly appreciate it. If you should require any further information or if you feel it may be necessary for us to attend the Council Meeting, please do not hesitate to call.
