Subject: PARKING - Church Street, Bowmanville. North side - between Division & George Streets, and west boulevard, Division St. Recommendation: THAT the Secretary of the Congregational Council of Trinity United Church be advised that parking will be permitted on the north side of Church Street, between Division Street and George Street, Bowmanville but that any parking on the west boulevard of Division Street cannot be permitted. Report: The attached correspondence is in request for parking to be permitted, on Sunday mornings, in the subject area. By-Law 79-1 details that parking can be permitted on the north side of Church Street, from Division Street to George Street, and in keeping with this the signs have been removed. Insofar as the request to park on the boulevard is concerned, By-Law 79-1 is very specific in the restrictions pertaining to same. Section I, Item (1) (b) defines a boulevard as follows: "'boulevard' means all the parts of the highway save and except any roadway, shoulder or sidewalk being that part of the highway lying between the property line and the edge of the sidewalk nearest to the property line and where there is no side- walk it means that part of the highway lying be- tween the property line and the travelled portion of the highway or the edge of the shoulder where such exists, furthest from the travelled portion of the road". Further to the above, Section III, Item (5) (1) specifies the following: "General Parking & Stopping Regulations 5) "No person shall, on any highway, park any vehicle: \ 1) "on or over a boulevard" t''� WD-95-81 (2) There are innumerable areas within the Town where it may be of advantage to local residents to park on the boul- evards and it is felt that, if the request under review was to be granted, the Municipality would be in a position of having set a precedent, notwithstanding the fact that such a by-law amendment would be in contravention of the Highway Traffic Act.
