Director's Report to Mayor and Members of Council, of July 27, 1981.
Date: July 24, 1981.
Subject: Encroachment, Chapel Street
Bowmanville.
Recommendation:
THAT part 2 on Plan 1OR-1203 be closed and conveyed to the abutting
owner for which compensation to be Seventy Five Dollars plus all
other associated costs.
Report:
Council by resolution #C-80-1109 and #C-80-1110 of August 15, 1980
authorized the closing and conveying of a portion of Chapel Street,
more clearly defined as part 2 on Plan 1OR-1203.
At that time in the absence of the Town Manager and the Clerk, an
appraisal was prepared by the Treasurer reason being an outside ap-
praisal would inflict an unnecessary cost representing more than the
actual value of the land involved.
The subject land has no true market value in that an encroachment
exists, one could also say that the land has a market value to the
*' abutting owner for reasons that an encroachment exists, and there-
fore would increase that property value.
It should be noted that the encroachment has existed since before
1857 and as a result has occupied the subject land since that
point in time. I would also point out that the land in question
will never be required for any future street improvements.
In view of the forgoing it is therefore recommended that the mat-
ter be finalized by closing and conveying as per the recommendation.
