REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE OF
OCTOBER 13, 1981.
REPORT NO. WD-117-81 October 1, 1981.
SUBJECT: Road Allowances between Lots 10 & 11, Lots
12 & 13 and Lots 14 & 15, Concession 6,
former Township of Clarke.
Request by Ministry of Natural Resources to
Close, and Close and Convey.
RECOMMENDATIONS:
It is respectfully recommended:
1. THAT this report be received, and
2. THAT it be recommended to Council that the
following resolution be adopted:
"WHEREAS the Council of the Town of Newcastle
adopts Report WD-117-81; and
WHEREAS the Ministry of Natural Resources has
requested that the Town of Newcastle convey
the road allowance in Lots 10 & 11, and close
and convey the road allowances in Lots 12 &
13 and Lots 14 & 15; and
WHEREAS Council does hereby grant approval to
the request of the Ministry of Natural Resources;
BE IT THEREFORE RESOLVED THAT the road allowance
in Lots 10 & 11, Concession 6, former Township
of Clarke, be conveyed, and the road allowances
in Lots 12 & 13 and Lots 14 & 15, Concession 6,

"former Township of Clarke, be closed by
by-law and conveyed, for a nominal sum plus
any associated costs incurred in effecting
the conveyance and closure and conveyance
in accordance with Town of Newcastle Policy"
BACKGROUND:
Correspondence dated September 14, 1981, received from
the Ministry of Natural Resources confirmed a discussion held on
September 2, 1981, during which Ministry representatives requested
that the Town of Newcastle give consideration to the Ministry's
acquisition of certain portions of three road allowances in the
_ vicinity of their Kendal property.
By-Law 1740 (August 5, 1972) and confirming By-Law 2324
(November 24, 1972) closed the road allowance between Lots 10 & 11,
Concession 6, former Township of Clarke, but did not convey same;
the Ministry now requests that this be conveyed.
The road allowances between Lots 12 & 13 and Lots 14 &
15, Concession 6, former Township of Clarke (see attached drawing)
are the subject of a request to close and convey to the Ministry,
at minimal cost plus whatever costs are associated with the
accomplishment of the transactions.
COMMENT:
None of the road allowances requested for conveyance to
the Ministry of Natural Resources are maintained and, from details
provided by that agency, it would appear that Ministry lands abut
or surround the lands under discussion.
The Town of Newcastle has no requirement or proposals for
the subject road allowances, or portions thereof, and, therefore,
has no objections to the requests.

The costs likely to be associated with the conveyance,
and closure and conveyances, of the three road allowances will
include fees for the preparation of individual Reference Plans
and Legal Descriptions of Land, and legal fees and any expend-
iture incurred in advertising the closure. Town Policy dictates
that the closure and conveyance of road allowances always be
T'at no cost to the Town" and, presumably, the Ministry of
Natural Resources will be in agreement with same; the `minimal
sum to be paid for the land comprising the road allowances is
suggested at two dollars ($2. 00) per road allowance, for a
total of six dollars ($6. 00) .

SUBJECT: Road Allowances between Lots 10 & 11,
12 & 13, 14 & 15, Concession VI, Clarke
Township, Town of Newcastle
This is to confirm our meeting (Dunham-Selby-Paterson) of
September 2, 1981 regarding the above-noted road allowances.
At present, the Ministry of Natural Resources is managing
Part Lots 1-16, Concession VI, known as the Kendal property,
as a day-use recreation area.
Over the past number of years, a considerable amount of damage
has been caused by four wheel drive trucks and motorcross bikes.
Due to steep slopes and the content of the soil, vehicular
disturbance has caused erosion problems.
In an attempt to control access to this property, this Ministry
has fenced and gated all possible entry points on Crown land.
As discovered at our meeting, the road allowance between Lots 10
and 11, Concession VI was closed through By-law 1740, dated
August 15, 1972 and confirmed by By-law 2324, dated November 24, 1972.
At this time, we wish to apply to the Town of Newcastle to close
up and convey to this Ministry, at minimal costs, the road allowances
outlined on the attached plan. We are presently soliciting comments
from the private landowners adjacent to these road allowances.
Upon receipt of these comments, we will forward them to your office.
