SUBJECT: Abandoned Well on Municipal Property.
Lots 21 & 22, Concession 9, former Township
of Darlington.
RECOMMENDATION:
It is respectfully recommended that:
1. This report be received, and;

2. The General Purpose & Administration
Committee recommend to Council that,
subject to the execution of an Agreement
between the Town and Mr. J. McLaughlin,
permission be granted to the latter to
use the well, located in Lot 21, Concession
9, former Township of Darlington, and;

3. That the term of the Agreement shall be
from year-to-year for so long as the land
in question is not required for municipal
purposes or public use.

BACKGROUND: i
Earlier this year it was brought to the attention of this
Department that the Ministry of the Environment had deeded all
rights, obligations and ownership of an abandoned well (formerly
owned by the Ontario Water Resources Commission and located on
Town-owned land) to Mr. J. McLaughlin, who wishes to use the well

to supply a house being built in Lots 21 & 22, Concession 9,
former Township of Darlington.
REPORT:
Staff have researched this matter and this Department has
no difficulty in agreeing with the proposal, providing that Mr.
McLaughlin enters into an Agreement with the Town in respect of
the use of the well.
It is recommended that the Town Solicitor prepares an
Agreement for execution, incorporating conditions that the Town
be saved harmless and indemnified from any damage, loss or injury,
and all effects and consequences thereof which may arise as a
result of the use of the well, and that the Agreement be renew-
able, periodically, for so long as the public land on which the
well is situated is not required for municipal purposes.
