SUBJECT: Road Allowance - Lots 30 & 31, Concessions
8 & 9, former Clarke (MacKay) .
Resolution # W-135-80.
BACKGROUND:
In May, 1980, a request was received to close the subject road
allowance, which is a Concession Road, located as above.
The Public Works Con nittee, at the Meeting of May 22, 1980,
passed Resolution # W-135-80, as follows:

As will be seen from (copy) Report WD-71-80, attached, in fact
the recommendation was for closure only.
The Policy of the Town of Newcastle, at the time of the subject
application, did not make provision for closure only of municipal
road allowances, but for 'closure and conveyance' . Thus, the
above Resolution # W-135-80, was endorsed by Council, albeit it
was contrary to the Applicant's request and the recommendation
to Committee.
REPORT:
In consideration of the fact that the road allowance is a
Concession Road, and bearing in mind possible future requirements
for improvements to the Municipal network of roads, it would not kr
be advisable to convey this particular section.
RECOMMENDATION: s
THAT the recommendation in Report WD-71-80 be endorsed and
that the road allowance in Lots 30 & 31, Concessions 8 & 9,
former Township of Clarke be cjo�e. , and Resolution # W-
135-80 be amended accordingly. I 9

THAT the recommendation in Report WD-72-80 be
Road Allowance endorsed and, conditional upon favourable
Closure, Lot 2, comments from the Planning Department, and the
Concession 4 concurrence of all abutting owners, a portion of
Darlington the road allowance in Lots 2 and 3, Concession 4,
(Nixon) former Township of Darlington, commencing at
Regional Road 4, southerly, for a distance of
approximately 4,300 feet, be closed and conveyed
in accordance with Town Policy.

Automatic endorsed and whereas proposed automatic signals
Signals for the C.P. R. Railway Crossing Mileage 155.66
C.P.R. Crossing (Belleville Subdivision) geographically located
Mileage 155,66 in Lots 22 & 23, B.F. Concession former Township
(Belleville Sub. ) of Clarke, are recognized in the Five Year Forecast,
the concerned parties be notified of same.

SUBJECT: Road Allowance - Lots 30 & 31,
Concessions 8 & 9, former Clarke.

Background:
The attached correspondence, dated May 8, 1980, requests that the
road allowance in Lots 30 & 31, Concessions 8 & 9, former Township
of Clarke, be closed, and the matter has been referred by the Clerk
for a report and recommendation to this Committee.
A portion of the road allowance in question is closed and, therefore,
consideration could be given to granting the present request.
Report:
It should be noted that, although numerous road allowances within
this Municipality should be closed, road closure is a very costly
procedure; it is suggested that, when requests are for closure only,
and not conveyance of the lands, such action should be applied to
only a selected number annually, for financial reasons.
Recommendation:
THAT, subject to the concurrence of any other abutting property
owners, the road allowance in Lots 30 & 31, Concessions 8 & 9,
be closed.

Dear Mr. McIlroy:
My farm is located in lots 30 and 31, concession 8, in the former
township of Clarke. I am writing with respect to the possibility
of closing an allowance which runs between my property on the 9th
line. Perhaps I should say my property runs on both sides of the
allowance and also that one end of the allowance is closed, thus
leaving a cul-de-sac situation which has continued to cause us
considerable concern. The allowance is used as a parking facility
fires have been lit in the evening and of course when Mosport throws
one of its major events, cars are often parked there for a day or mare.
The resulting refuse usually finds its way into my hay fields, usually
empty liquor and beer bottles, garbage etc. . With my cattle on one
side of the road and hay fields on the other, it remains a source or
worry, particularly as I say, during the summer months when activities
at Yosport are in full swing. In the wintertime, the allowance has
been used by skidooers who usually end their skidooing activity by
cutting through the fence as they head for the open field. The road �� �
runs east and west and as mentioned in this letter, the western end
already is closed as it runs into the private property of Carl Wilson
and has been fenced for the past several years.
