Director's Report to Public Works Committee.
ITEM: WD-84-80.
DATE: June 17, -1 9th.
SUBJECT: Road Closure - Lot 2, Concession 4, former Darlington.
BACKGROUND:
At the Public Works Committee of May 22, 1980, Report No. WD-72-80
was considered relative to a request for the closure of the subject
road allowance. Whereas the original request was for closure only,
Resolution # W-136-80 was passed, and subsequently adopted, as
follows:
"THAT the recommendation in Report WD-72-80
be endorsed and, conditional upon favourable
comments from the Planning Department, and
the concurrence of all abutting owners, a
portion of the road allowance in Lots 2 & 3,
Concession 4, former Township of Darlington,
commencing at Regional Road 4, southerly,
for a distance of approximately 4,300 feet,
be closed and conveyed, in accordance with
Town Policy".
REPORT:
Upon being notified of the foregoing, the original applicant, Mr.
Henry Nixon, and oiie other abutting owner, Mr. A. Verbrugghe, have
submitted the attached correspondence, pointing out that they are
primarily interested only in the closure of the road allowance and
not in the acquisition of the lands comprising same. The owners
state that, if the Town will agree to close the road (retaining
the land rather than conveying same) and erect a farm fence in
order to protect their respective properties, they will defray
the costs incurred by the Town in effecting the road closure.
The Town of Newcastle Policy relevant to Road Allowances does not
make provision for the above, but addresses itself only to the
eventuality of closure and conveyance; there is no provision for
the Town to close,and retain ownership of, municipal road allow-
ances.

REMMNDATION:
THAT, whereas the Town of Newcastle may at
some time wish to close municipal road all-
owances and retain ownership of same, the
Policy for the Closure and Conveyance of
Road Allowances be reviewed by the Public
Works Committee.

Dear Mr. Dunham:
Re: Road Allowance in Lot 2, Concession 4, Darlington.
With reference to the letter from Mrs. G. Gray, dated
June 3, 1980, and Resolution # W-136-80, we would like
to point out that the original request in respect of
the road allowance was for closure only.
We owners, whose property abuts the road allowance, are
mainly concerned that the road allowance be closed and
fenced, in order to protect our crops and prevent any
access by off-road vehicles, etc. We do not necessar-
ily wish to buy the land.
It would be appreciated if you would confirm that it
will be in order for the road allowance to be closed
one.
We would like to make it clear, however, that we are
quite willing to pay any fees incurred by the Town in
closing this road allowance, conditional upon the erect-
ion of a farm fence to protect our properties.
We look forward to hearing frm you in the very near
future.

SUBJECT: Road Allowance - Lot 2, Concession 4,
former Darlington.
Background:
The attached correspondence, dated April 29, 1980, is requesting
that a road allowance, geographically located in Lot 2, Concession
4, former Township of Darlington, be closed.
Report:
According to By-Law 2111, the status of the road allowance in
question is 'Unimproved' , and it has not officially been closed
by by-law.
Recommendation:
THAT, conditional upon favourable comments from the Planning
Department, and the concurrence of all abutting owners, a portion
of the road allowance in Lots 2 & 3, Concession 4, former Township
of Darlington, commencing at Regional Road No. 4. , southerly, for
a distance of approximately 4,300 feet, be closed.
