Subject: Weight Restrictions on Municipal Roads.
Background:
Section 77 of The Highway Traffic Act, R.S.O. 1970, makes
provision for weight restrictions on roads to be imposed during
the months of March and April. Section 77, Subsection (10) (see
attached) enables a Municipal Corporation to extend such re-
strictions during any period of the year.
Report:
It is felt that the imposition of weight restrictions could be
advantageous during part of May as it is more likely that roads
will suffer deterioration at this time.
Recommendation:
WHEREAS a Municipal Corporation may extend the period under
which weight restrictions shall apply, it is therefore rec-
ommended that a by-law be passed to the effect that weight
restrictions will be in force on roads under the jurisdiction
of the Town of Newcastle, effective March 1st to May 21st,
inclusive.

Governor in Council may declare the provisions of sub-
sections 5, 7 and 13 to apply during any period of the year,

(10) The municipal corporation or other authority having Extension or
jurisdiction over any highway may declare the provisions of Pe lCipallty
subsections 5, 7 and „13 to apply to highways under its
jurisdiction during any period of the year, or that the pro-
visions of subsections 5 and 7 do not apply to any or all
highways under its jurisdiction. 1978, c. 90, s. 7 (1).
(11) The Lieutenant Governor in Council may make regu-Reions

lations limiting the gross vehicle weight of any vehicle or weight
any class thereof passing over a bridge forming part of the ovrgbBdge
King's Highway or a highway in territory without municipal
organization and notice of the limit of the weights fixed by
such regulation, legibly printed, shall be posted up in a con-

(12) The municipal corporation or other authority having By-lawB

of stibsection 11 with respect to the posting up of notice

(13) Every person who contravenes any of the provisions Penalty
of subsection 1, 5, 6 or 7 or of a regulation made under
subsection 11 or a by-law made under section 12 is guilty
of an offence and on summary conviction is liable to a fine
as if he had been convicted under section 79 and, in addition,
if the conviction is for a contravention under subsection 1,
the Registrar may suspend the permit issued under section
6 for the vehicle or vehicles involved, and such suspension
shall continue until a new permit at the maximum gross
vehicle weight allowable has been issued for the vehicle or
vehicles and the fee therefor has been paid. 1977, c. 65, s. 3,

78,—(1) Where a police officer or officer appointed for Poweror
carrying out the provisions of this Act has reasonable and i„+T'voei Aa
probable grounds to believe that the gross vehicle weight weighed
of a vehicle or combination of vehicles is in excess of the
limits permitted under this Act or the regulations or a•permit
issued for the vehicle or combination of vehicles, he may
weigh the same, by means of either portable or stationary
scales, and may require that the vehicle or. combination
of vehicles be driven to the nearest weigh scales.
(2) Subsection t does not apply where the driver of a Com- Production
