Subject: Road Allowance and former Dump Site. Lots 32 & 33, Concession 6, CLARKE. Background: The attached correspondence, from Mr. Robert H. Kingsley, was referred by the Town Clerk for a report to the Public Works Committee. Mr. Kingsley is requesting that the Town consider selling the former Dump Site and subject road allowance. In January of 1974, in accordance with Bill 162, the Regional Municipality of Durham assumed jurisdiction of dump sites; at that time the subject site had already been closed. Subsequently, in 1976, as a result of a request by the Town of Newcastle, the Region conveyed the site back to this Municipality subject to restorations of same being undertaken, in accordance with the requirements of the Ministry of the Environment. Restoration of the site, which consists of 11.13 acres, con- sisted of levelling same, and in 1977 the Orono Boy Scouts planted some trees on the land; since that point in time, however, no further improvements have been made. Report: If the Town of Newcastle wishes to retain the former dump site, further improvements/restoration works will be required. It should be noted, however, that this land would appear to be more of a liability than an asset. The road allowance is an original allowance for road, being sixty- six feet (66 ft. ) in width, but has never been opened. Due to theU y existing terrain and the location of the Creek it would be im- practical, if not impossible, to open this road. � WD-29-80: - 2 - Recommendation: i. THAT the appropriate Committee consider the disposal, by Tender, of the former Dump Site situated in Lot 33, Concession 6, former Township of Clarke. ii. THAT the road allowance in Lots 32 & 33, Concession 6, former Township of Clarke, be closed and conveyed, in accordance with Town of Newcastle Policy and The Municipal Act.
