Subject: Bowmanville Heights Subdivision (Phase II)
Plan 705. Assumption by Town of Newcastle. y
Background:
In 1973, the former Town of Bowmanville entered into a Subdiv-
ision Agreement with Mutt Enterprises and York River Heights
Limited, for the construction of a 104-lot Subdivision in the
south-west section of Bowmanville.
The Subdivision was placed on a Maintenance Program as of
December, 1977, and should have been assumed by the Town one
year later. Due to various deficiencies the acceptance of the
Subdivision was delayed; however these have now been rectified
and the Developer has complied with the Terms of the Agreement.
Report:
In the latter part of 1979, representatives of the Region of
Durham and the Town of Newcastle inspected the Subdivision and
determined that all previous deficiencies had been corrected.
The following information is now applicable to Bowmanville
Heights Subdivision (Phase II) Plan 705:
(a) Region of Durham (Final) Acceptance --- March, 1979.
(b) Bowmanville P.U.C. Acceptance - July, 1977.
(c) Town of Newcastle Acceptance - January, 1980.
(d) As Constructed Drawings - received - 1978.
(e) Surveyor's Certificate - received - May, 1978.
(f) Lot Levies (Paid in Full) Gross: - $ 84,600. 00
Less Oversizing Costs: - $ 14,431. 00
Net: - $ 70,169. 00

One condition of the Subdivision Agreement was that the Developer
was to construct a road across Lots 9 & 31 to provide temporary
access into the Development. In January of 1978 it was decided,
between the Town and the Developer, that this temporary access
was not required in the detail as included in the Agreement and
a Supplementary Agreement was entered into relative to this item.
This entailed the construction of a Walkway, and a cash settle-
ment of $10,000. 00.
The conditions of the foregoing Supplementary Agreement have now
been met; the Walkway has been constructed and approved and payment
(through the Town Solicitor) of $10,000. 00 has been made.
Recommendation:
THAT Bowmanville Heights Subdivision, Phase II,
Registered Plan No. 705, be assumed by by-law
by the Town of Newcastle and the Subdivision
Agreement be released and, further, that the
Town Solicitor prepare the necessary release
for execution and registration by the Town.
