THAT Addendum to Report CLD-35-04 be received; 2. THAT a further report be presented to the General Purpose and Administration Committee of December 6, 2004 addressing the issue of the installation of emergency lights in taxi cabs; and 3. THAT the taxi by-law be presented to Council on December 13, 2004. Provision of 24-Hour Service This provision is included in the by-law to ensure that the municipality has round the clock taxi service coverage. What this means to the taxi cab companies is that they will be required to have a minimum of two cars and two drivers available to work for them at all times to ensure their ability to provide 24 hour coverage, and must provide documentation to that effect. 2. InsDections Durinq Reasonable Times Section 7.1 of the by-law provides that: "The Clerk, the Chief of Police, the Medical Officer of Health, the Fire Chief, a Municipal Law Enforcement Officer or any person acting under these persons or any person authorized by Council may at reasonable times during business hours inspect: a) any premises or place where a trade which is subject to this by-law is carried on or any such person has reasonable or probable grounds to believe such a trade is being carried on, b) any goods, equipment, books, records or documents used or to be used by the applicant or licensee under this by-law." Under this provision, random safety checks are carried out by the Police Department, Municipal Law Enforcement Officers and Inspectors with the Ministry of Transportation. Maximum Lenoth of Time on Dutv Questions arose as to the amount of time a driver is allowed to be on duty. With few exceptions, the Employment Standards Act applies to all employees working in the Province of Ontario. In accordance with this Act, employees cannot be forced to work more than 8 hours a day (or the number of hours in a regular work day, if it's more than 8) and 48 hours a week. Subject to certain requirements, employees can agree in writing to work more than these limits. However, employees must have at least 11 consecutive hours off work each day and 24 consecutive hours off work each week or 48 consecutive hours off work in every two-week period. To ensure the taxi companies are aware of this requirement, a section has been added to the proposed by-law stating that the taxicab/limousine brokers shall comply with the Employment Standards Act. 4. Clarification of the Discretionarv $15.00 Surcharoe Report CLD-035-04 introduced a flat surcharge for remote locations. Any call for service which commences or terminates from a location more than 15 kilometres away from the company's dispatch office can be charged an additional $15.00. The fee is at the discretion of the driver prior to the commencement of the trip and must be made clear to the customer at the time of booking the cab. The wording on Schedule C of the by-law (Taxi Tariff Schedule) did not reflect that the fee is discretionary, but has now been amended to clarify this. Inclusion of Emerqencv Liqht The issue of the installation of an emergency light was raised at the meeting. In order to better address this matter, staff wishes to discuss the issue with the taxicab operators of the municipality. A further report addressing this item will be submitted to the General Purpose and Administration Committee at the meeting scheduled for December 6, 2004. Following consideration of a further report at the next General Purpose and Administration Committee meeting, the new taxi by-law will be presented to Council for passage.
