Subject: Dedication of Lands
as Public Highways.
Background:
Since 1977 the Town of Newcastle has entered into three Development
Agreements for the construction of industrial subdivisions and, in all
three instances, land has been dedicated to the Town for road widening
purposes.
The Industrial Subdivisions are as .follows:
(a) Solina Industrial Subdivision,
Trull' s & Baseline Roads,
(Plan IOR-813) .
(b) Darlington Industrial Subdivision,
Baseline & McKnight's Roads,
(Plan IOR-708) .
(c) Marnie Industrial Park,
Regional Road 34 & baseline Road.
(Plan IOR-933) .
Report:
It transpires that concerns have been expressed by purchasers of
property which abuts a road widening within the above subdivisions,
in that they do not feel they have any legal right to enter over such
widenings.
It is our opinion that these concerns are a matter of legal interpret-
ation but, as a condition of the dedications is that they are for road
widening purposes, it would be practical to pass a By-Law declaring
the relevant lands as Public Highways.
Recommendation:
THAT a By-Law be prepared declaring the following road widenings as
Public Highways:
1. Part 13, Plan IOR-813.
2. Parts 17 & 21, Plan IOR-708.
3. Parts 8,9,10 & 17, Plan IOR-933.
