Item: Report No. 11.
Date: November 21, 1979.
Subject: POLICY - Dewatering of Wells.
Background:
A Policy regarding the dewatering of and/or interference to
a well or private water supply was established in February,
1978 (see attached) .
Report:
Recently, as a result of storm sewer construction, two wells
were affected adversely, and the subject Policy was to be
applied to the situation. However, it was found that the
definitions within the Policy were somewhat obscure in that
the area in question was water-serviced and service connections
existed at the property line and this was an eventuality which
was not defined clearly.
Discussion at the Public Works Committee Meeting of October
30, 1979, indicated that possibly the Policy should be reviewed.
Report No. 11, to Council (attached) in Recommendation No. 2.
suggested that the Policy be reviewed in order to clarify and
define all contingent situations.

Subject: UeyateriuA of Wells - Orono.
Construction of the Storm Sewer no Division Street in Orono
resulted in the 6ewateriog of two private wells on Sommerville
Drive.
At the Public Works Committee Meeting of October 30^ 1979, the
subject matter was discussed and Resolution # W-244-79 was passed,
as follows:

(Attached is the Policy of the Town of Newcastle in �eoyect of

. Ihe affected wells are oil the properties of Mr. Victor Robinson,
whose well has been totally dewuLered for approximately five
weeks, and Mr. John SbetIer, whose well is now such that it will
not adequately supply the needs of the uvnzor as it has in many
years past.

Both the aforementioned properties are in u water-serviced area
and have connections from the main to the property liuea. Item 4
of the Iowu/u Policy provides for restoration in a water-serviced
area, such as that which ie under consideration in this instance.

be as follows:

Total costs: 1,380. 00
If Item 4 of the Town Policy had been applicable in the case
under discussion, each property owner would be required to con-
tribute $200. 00 for the provision of the service to the property
line and then would be entirely responsible for any expenditure
involved in extending the service from the property line to the
house plumbing. The total costs given above would, thus, be
/ reduced by $400. 00 leaving a net expense to tba . no of $980. 00.
As Item 4 is not applicable, coat estimates to supply and ioatull
water services, from the property line to- the existing _212Tbin
in the two dwellings,On consideration of the coat estimates it is found that the
figures are as follows:
$690. 00 f $550. 00 (= $1,240. 08) + 2 x $25 Inspection Fees
Total coat of installations: $1. 298. 80.
Recommendation:
(l) WDEREAS Storm Sewer construction has resulted- in the
dewnteriuA of two wells on Sommerville Drive, Orono,
and the current Policy of the Iovo is not totally
applicable in the case, it is hereby recommended that
water supply of a permanent nature he restored and that
the ?own of Newcastle install the mater services, from
the property lines to the existing house plumbing, at
no costs to the affected property owners.
(2) THAT the Policy of the Town of Newcastle with respect
to the dewateriu& o{, and/or interference to private
wells, be reviewed in order to clarify and define all
contingent aituatioua.

l. Where the interference to a well or private water supply is of

one month of the completion of dewutering, the T*vm will make
available to the affected party a temporary supply of water, at
no cost to the affected party.
2. Where the loterIuz*uce to u well or private water supply is of
long-term or permanent duration, outside u water-serviced area,
the ?onu will take whatever action is deemed necessary, by the
Director of Public Works, to restore the water supply.
2. Should u property affected by Clauses l & 2 be eventually

with Regional Policy at that time.
4. Where the interference to u well or private water supply is of
long-term or permanent duration, and where the interference takes
place in u water-serviced area, the affected party will be required
to make a payment of $200, 00 (Iwo Hundred Dollars) effective
February, 1978, towards the coat of the connection from the main
to the street line, and will be responsible for the full cont
of any work necessary on private property.

The following Resolutions are incorporated into the attached:

Resolution # W-52--78:
Item 2 on THAT this Committee concurs with Report # 13 of the Director of
Report to Public Works subject to an amendment on Page 2 to read: "The
Council: following is the Policy of the Town of Newcastle" prior to Items
1, 2, 3, and 4 of the Report.
Resolution # W-53-78:
Item 3 on THAT the amendment to the Policy established in Report # 13 of the
Report to Director of Public Works be approved and recommended for adoption.

Resolution # C-78-245:
THAT Item No. 2 of the foregoing (Public Works Committee) Report
be adopted.
Resolution # C-78-246:
THAT Resolution # C-78-245 be amended to provide that the
following words be added after the word "Newcastle" in the
fourth line of Resolution # W-52-78: "with respect to
dewatering and/or interference to private wells caused by
the Town of Newcastle".
Resolution # C-78-247:
THAT Resolutlon # C-78-245 be further amended by adding the
words: "at no cost to the affected patty".

Background:
Construction of the Storm Sewer on Division Street in Orono
resulted in the dewatering of two private wells on Sommerville
Drive.
At the Public Works Committee Meeting of October 30, 1979, the

The affected wells are on the properties of Mr. Victor Robinson,
whose well has been totally dewatered for approximately five
weeks, and Mr. John Shetler, whose well is now such that it will
not adequately supply the needs of the owner as it has in many
years past.

Recommendation:
