THAT Report COD-052-02 be received; 2. THAT Jeffrey G. Wallan's Contruction Ltd., Brighton, Ontario with a total bid in the amount of $ 47,133.50 (Including G.S.T.), being the lowest responsible bidder meeting all terms, conditions, and specifications ofTender CL2002-30, be awarded the contract for the Splash Pad Renovations, Orono Park; 3. THAT the funds required in the amount of $30,000.00 be drawn from the Engineering Capital Account # 7603-00100~0516; 4. THAT the additional funds in the amount of $27,000.00 ($47,133.50 less GST rebate, plus design, plus contingency less $30,000.00 Budget Account # 7603-00100-0516) be drawn from the Public Works Parks Capital Reserve Fund and processed through Account #7603-00100-0516; and 5. THAT the attached By-law marked Schedule "A" authorizing the Mayor and the Clerk to execute the necessary agreement be approved; FORTHWITH. Director of Engineering Services MMILABIASClkm 1201 c REPORT NO.: COD-52-G2 PAGE 2 BACKGROUND AND COMMENT Tender specifications were provided by Totten Sims Hubicki Associates for the Splash Park Renovations, Orono Park, within the Municipality of Clarington, as required by the Engineering Department. Tenders were advertised in local papers, as well as the Daily Commercial News. Subsequently, tenders were received and tabulated as per Schedule "B" attached. The total funds required, including a final design and tendering, contract administration, utility relocations, contingency and net GST, is detailed in the letter from Totten Sims Hubicki, marked Schedule "B" is estimated at $57,000.00. Although the low bidder has previously performed work for the Municipality of Clarington, they have also recently completed similar work for the City of Oshawa and City of Belleville. A FORTHWITH APPROVAL is requested in order to allow the contractor to commence work before the winter season. The total funds required exceed the budget allocation of $30,000.00 as detailed in the 2002 Engineering Capital Budget, page 271, Account # 7603-00100-0516. The high price submitted is attributed to the inability to access the site with heavy equipment. The only construction access to the site is via a light vehicle bridge over the creek. It is therefore recommended that the additional funds required in the amount of $27,000.00 ($47,133.50 less GST rebate, plus design, plus contingency less $30,000.00 Budget Account # 7603-00100-0516) be drawn from the Public Works Parks Capital Reserve Fund and processed through Account #7603-00100-0516. The Director of Finance has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, specifications, etc., should be referred to the Director of Engineering Services. 1202 < REPORT NO.: COD-52-o2 PAGE 3 After further review and analysis of the bids by the Engineering Department, Totten Sims Hubicki and Purchasing, it was mutually agreed that the low bidder, Jeffrey G. Wallan's Construction Ltd., Brighton, ON, be recommended for the contract for the Splash Pad Renovations, Orono Park. Schedule "A" THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW 2002- Being a By-law to authorize a contract between the Corporation of the Municipality of Clarington and Jeffrey G. Wallan's Construction, Brighton, Ontario, to enter into agreement for the Splash Pad Renovations, Orono Park. THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the Corporation of the Municipality of Clarington and seal with the Corporation Seal, a contract between, Jeffrey G. Wallan's Construction, of Brighton, Ontario, and said Corporation; and 2. THAT the contract attached hereto as Schedule "A" form part of this By-law. WaIJans Construction Ltd. has completed similar scale and larger scale projects for the City of Oshawa, Trent University and the City of Belleville over the past few years that were comparable to the works required under this contract. The references contacted stated that these works were completed with an acceptable level of quality and workmanship. Thc works includcd in this tender are required to replace the existing wading pool with a <pray pad to provide a "wet park. environment consistent with the standards the Municipality is implementing in olher parks. The total tender amount of $47,133.50 (inclusive of G.S.T.) i< higher than similar types of woek previously undertaken by the Municipality. TIle inability to access tIle site with heavy construction equipment is the major reason for the higher price. The wodcs included in the Teuder were identified in the 2002 Capital Budget and Four Yeae Forecast. $30.000 has been budgeted for this project. A cost apportionment is attached detailing the estimated project costs based On the low bid submitted by Jeffrey G. Wallans Construction Limited. As the total tcndcr amount, including associated design and administration costs, are $27,000 higher than what has been budgeted it is recommended that: · $57,000 be drawn from the previously budgeted Account # 7605-00100-0516. The $27,000 deficit will be financed from the P/W Parks Capital Reserve Fund. As funding has been made available for the total project costs and based on the past experience of the low bidder it is reeommcnded that Contract CL2002-30 be awarded to Jeffrey G. Wallans Construction Limitcd for the total amount of $47,133.50 (incl. of a.S.T.). Tender deposits may be returned to all contractors except the low and second low bidders.
