Item: Frank Street, Bowmanville.

Subject: Drainage.
Background:
Attached is all background data and information relative to the
subject matter.
Report:
Since approximately 1976 the matter of drainage in the area of
Frank Street in Bowmanville has been the subject of discussion.
After exhausting all possible avenues which could have alleviated
the drainage problems, Report No. 145 was compiled and presented
to the Public Works Committee of May 1, 1979.
On June 18, 1979, a Petition for Drainage was presented to Council
who, by Resolution # C-754-79 received same and directed that the
Petition be dealt with under 'Other Business' . Subsequently, as
will be seen from the attached (Page 15, Council Minutes of June
18, 1979) 'No action was taken on the Petition filed under The
Drainage Act' .
Attached is a copy of The Drainage Act, 1975, and Drainage Act -
Petition Drains Procedure, for information purposes. These documents
clearly define the appropriate procedure to be followed in order
to conform with The Act.
In view of numerous delays it would appear that the Town has now
lost the 1979 construction season for a project of the nature of
Frank Street drainage.
Conclusion:
In view of the fact that Council took no action regarding the
Petition, one of the following alternatives could be considered:
1. Appeal to the Tribunal. r`� f
