Subject: Part Lot 5, Concession 4, Darlington. Redesignation of Road Allowance. Background: Correspondence received from Mr. Douglas J. Barber, dated May 6, 1979, requested that the subject road allowance be re- designated and the status changed from 'unimproved' to 'improved' . Report: The subject road allowance is an original allowance for road and is 66 ft. in width. By-Law 2111 has designated the road as 'improved' with the except- ion of approximately 300 ft. , the latter distance being classed as 'unimproved' . This section is maintained and is of similar standard to that which is designated as 'improved' . I act for the estate of the above-named who died last November owning the lands described on the enclosed photocopy of legal description and depicted as the, 'lot 5 ' portion of the enclosed sketch. The beneficiaries of the estate wish to sell the lands but have found that a building permit is not available for a prospective purchaser as the 4th concession road abutting the lands on the south is designated as, 'unimproved' in the area alongside the lands . The market value without a permit appears only about $13000.00 whereas it would approach $40, 000.00 if a new residence could be built thereon. The residence on it now is only partly completed and would not be suitable for most purchasers as a base for a new building. The road immediately to the east is designated 'improved' and the road alongside the estate land is in fact maintained year round by the township so that re-designating it would only be to conform to the factual status-quo. My clients would like the opportunity to appear as a delegation before your committee on this subject if you are not inclined to recommend the re-designation. Please advise .
