THAT Report CD-25-96 be received; 2 . THAT an exemption from Sections 2a) and 3 (1) of By-law 91-56 be granted to allow the Clerk to issue a Special Events Licence to Mosport Park Limited for racing events to be held on May 16 to 20, 1996, and May 31 to June 2, 1996; and 3 . THAT Bernard Kamin and Nelson Hudes be advised of Council' s decision. BACKGROUND AND COMMENT: Mosport Park Limited has submitted applications to the Municipality for special event licences in accordance with By-law 91-56 for the scheduled racing events this season. In previous years, the licences for the racing events were issued pursuant to By-law 78-50 . It has been determined, however, that By-law 91-56, Exhibitions Held for Hire or Gain, more accurately applies to the events . Once Mosport was made aware of this, the appropriate application forms were submitted together with the applicant' s licence fees . The only outstanding issues at the time of writing of this report are : • Insurance policy - has been submitted by Mosport' s insurance agent and is being reviewed by the Municipality' s insurer to ensure compliance with our by-law. Continued . . . . . /2 AECL 604 RECYCLED RECYCLE THOS 6 PF 1tRTD D!RECYCLED PAPER Report CD-25-96 - 2 - May 6, 1996 • Requirement of the Director of Public Works - Mosport has submitted a cheque in the amount of $30, 000 in order to reimburse the owners of land within 150 metres of the site for damage . By letter dated April 25, 1996, the Director of Public Works advised Mosport of the method of determining, repairing and paying for any damage . Confirmation of these items by Mosport is awaited. Because By-law 91-56 states that the application for a special events licence must be submitted to the Clerk at least 45 days prior to an event and the licence must be issued at least 30 days prior to an event, it is recommended that an exemption be granted to Sections 2a) and 3 (1) to allow for licences to be issued for the racing events scheduled for May 16 to 20, 1996 and May 31 to June 2, 1996 . It should be noted that the race being held on May 16 to 20 also includes a concert on the Saturday night .
