Subject: MUNICIPAL ELECTIONS ACT SUPPLEMENTARY STATEMENT
Reco VTPspectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report CD-26-95 be received for information.
BACKGROUND AND COMMENT:
On July 17, 1995, Council received Report CD-23-95 outlining the
Clerk' s Statement of Candidates Disclosure of the 1994 Municipal
Elections .
This statement indicated that seven individuals, i .e. ,
Marc Battle (Public School Board Trustee, Ward 2) , James Church
(Public School Board Trustee, Ward 1) , Ann Cowman (Mayor) ,
Thorsten Koseck (Public School Board Trustee, Ward 1) ,
Leo Stafford (Local Councillor, Ward 1) , Leon Vandenhoven
(Hydro Commissioner) and Reginald Willatts (Hydro Commissioner)
had not complied with the Municipal Elections Act by failing to
file a financial statement by June 30, 1995 .
In accordance with the Municipal Elections Act, Sections 150 (6)
(7) , demand notices were sent to the seven individuals by
registered mail on July 10, 1995 .
The demand notice states that the registered candidate, if
elected, shall forfeit the office and, whether elected or not,
shall be ineligible to hold any office up to and including the
next regular election if the candidate fails to file a statement
within 30 days of the date of the notice.

Attached hereto is a copy of the Supplementary Statement filed
under Section 150 (9) of the Municipal Elections Act . As shown on
the statement, Ann Cowman, Thorsten Koseck, Leo Stafford and
Reginald Willatts filed their statement of election finances
within the 30 day period of the notice of demand. Marc Battle,
James Church and Leon Vandenhoven failed to file their statements
within the specified time frame and are, therefore, ineligible to
hold any office in the Municipality of Clarington up to and
including the 1997 Municipal Elections.
