Subject: APPROVAL OF TILE DRAINAGE LOAN APPLICATION - JOHN ROZNIK
Recommendations:
It is respectfully recommended that Council approve the
following:
1 . THAT Report CD-35-95 be received;
2 . THAT the Tile Drainage Loan Application submitted by
John Roznik in the amount of $17, 000 be approved;
3 . THAT the by-law attached to Report CD-35-95 be approved and
forwarded, together with all necessary support documents, to
the Regional Municipality of Durham for processing; and
4 . THAT John Roznik be advised of Council' s decision.
BACKGROUND AND COMMENT
Mr. John Roznik filed a loan application for the drainage work
which was completed in December 1995 . Invoices totalling
$22, 647 . 85 were submitted to the Public Works Department for
review. The Drainage Inspector inspected the works and file an
Inspection and Completion Certificate (attached) on December 5,
1995 in the amount of $17, 000, being 75 percent of the total cost
of the works . (Under the Tile Drainage Act, the amount of the
loan requested must not exceed 75 percent of the total cost . )

It is recommended that the Tile Drainage Loan Application in the
amount of $17, 000 be approved, the necessary by-law be passed,
and all documentation forwarded to the Regional Municipality of
Durham for processing.

BY-LAW 95-185
being a by-law imposing special annual drainage
rates upon land in respect of which money is
borrowed under the Tile Drainage Act, R.S .O. 1990
WHEREAS owners of land in the municipality have applied to the
Council under the Tile Drainage Act, R.S .O. 1990, for a loan for
the purpose of constructing sub-surface drainage works on such
land;
AND WHEREAS the Council of the Corporation of the Municipality of
Clarington has upon their application, lent the owners of Part
Lot 8 , Concession 1, former Township of Clarke the total sum of
$17, 000 . 00 to be repaid with interest by means of rates
hereinafter imposed;
BE IT THEREFORE ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
MUNICIPALITY OF CLARINGTON:
1 . THAT annual rates as set out in Schedule "A" attached hereto
are hereby imposed upon such land for a period of ten (10)
years, such rates to be levied and collected in the same
manner as taxes .
By-law read a first and second time this 11th day of December
1995 .
By-law read a third time and finally passed this 11th day of
December 1995 .
