Subject: APPROVAL OF TILE DRAINAGE LOAN APPLICATION

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report CD-2-94 be received;
2 . THAT the Tile Drainage Loan Application submitted by
Joe Christl in the amount of $16,500 be approved;
3 . THAT the by-law attached to Report CD-2-94 be approved and
forwarded, together will all necessary support documents, to
the Regional Municipality of Durham for processing; and
4 . THAT Joe Christl be advised of the actions taken.
BACKGROUND AND COMMENT:
Mr. Joe Christl filed a loan application for tile drainage work
which was completed in November 1993 . Invoices totalling
$22,039 .27 were submitted to the Public Works Department for
review. The drainage inspector inspected the works and filed an
Inspection and Completion Certificate (attached) on January 4,
1994 in the amount of $16,500, being 75 percent of the total cost
of the works. (Under the Tile Drainage Act, the amount of the
loan requested must not exceed 75 percent of the total cost. )

It is recommended that the Tile Drainage Loan Application in the
amount of $16,500 be approved, the necessary by-law be passed,
and all documentation forwarded to the Regional Municipality of
Durham for processing.

BY-LAW 94-
being a by-law imposing special annual drainage
rates upon land in respect of which money is
borrowed under the Tile Drainage Act, R.S.O. 1990
WHEREAS owners of land in the municpality have applied to the
Council under the Tile Drainage Act, R.S.O. 1990, for a loan for
the purpose of constructing sub-surface drainage works on such
land;
AND WHEREAS the Council of the Corporation of the Municipality of
Clarington has upon their application, lent the owners the total
sum of $16,500.00 to be repaid with interest by means of rates
hereinafter imposed;
BE IT THEREFORE ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
MUNICIPALITY OF CLARINGTON:
1. THAT annual rates as set out is Schedule "A" attached hereto
are hereby imposed upon such land for a period of ten (10)
years, such rates to be levied and collected in the same
manner as taxes.
By-law read a first and second time this 24th day of January
1994.
By-law read a third time and finally passed this 24th day of
January 1994.
