Subject: PARKING ENFORCEMENT AT BOWMANVILLE MEMORIAL HOSPITAL

Administration Committee recommend to Council the following:
1. THAT Addendum Report to Report CD-14-94 be received;
2 . THAT Report CD-14-94 be received;
3 . THAT the two hospital staff members and the four security guards
listed on the letters from the Hospital and Burns Security be
appointed By-law Enforcement Officers for the sole purpose of
enforcing the Traffic By-law on the Hospital property;
4 . THAT the By-law attached to Report CD-14-94 appointing these people
be forwarded to Council for approval; and
5 . THAT Keith Kelly and the Durham Regional Police be advised of
Council's decision and forwarded a copy of the Addendum to
Report CD-14-94 .
REPORT
At the Council meeting held on April 26, 1994, the Council approved
Recommendation #GPA-251-94 which stated in part, " . . .that a meeting will
be held with staff of the Bowmanville Memorial Hospital requesting them
to investigate if members of their staff are parking on Prince Street to
avoid paying the daily parking fee. . . "
On May 5, 1994 staff met with Andre Hendrik.s, Director of Environmental
Services for the Hospital. Mr. Hendriks confirmed that there has been
a problem with some of the staff parking on the street in order to avoid
paying the required $2 .00 to park in the lot. Memos have been sent to
the staff in the past with little effect.

As a result of the meeting the following course of action was decided.
Since the problem primarily arises at night, staff contacted the Durham
Regional Police and requested their assistance in the matter. They have
indicated that they will assist as best they can. Both the Hospital and
the By-law Division have sent a letter to the Regional Police formally
requesting them to strictly enforce the prohibited parking area around
the Hospital.
A second letter will be sent to the Hospital from the By-law Division
advising them that the matter will be followed up and strictly enforced
by the police and our officers, where possible. Mr. Hendriks will then
post a memo to all hospital staff as a final warning not to park on the
street.
RECOMMENDATION
The Hospital administration has demonstrated a willingness to resolve
this matter and take responsibility for parking on their own property.
It is therefore recommended that the two hospital staff member and the
four security guards listed on the letters from the Hospital and Burns
Security which appeared in Report CD-14-94 (a copy of which is attached)
be appointed By-law Enforcement Officers for the sole purpose of
enforcing the Traffic By-law on the Hospital property and that the By-
law attached to Report CD-14-94 appointing these people be forwarded to
Council for approval.

RE: PARKING ENFORCEMENT AT BOWMANVILLE MEMORIAL HOSPITAL
This department has received several complaints concerning vehicles
Parked overnight on Prince Street in the area of the Bowmanville
Memorial Hospital.
After discussions with the management of the hospital it is
apparent that several of these vehicles are in fact employees of
the hospital who are parking on the street in order to avoid paying
for the parking lot. This situation has caused serious concerns
among the neighbours and I am therefore requesting the assistance
of your officers in resolving this matter.
I have contacted the hospital and advised them in writing that if
the situation does not improve, vehicles may be tagged or towed if
necessary in order to resolve this matter.
I realize there are several serious limits and constraints upon
Your officers ' availability to enforce this matter however, any
assistance that they can give us would be greatly appreciated.

RE: ON-STREET PARKING ENFORCEMENT AT BOWMANVILLE MEMORIAL HOSPITAL
On April 25, 1994, the Council of the Municipality of Clarington
passed a resolution directing this office to liaise with your
facility in regards to the problem of staff members parking on
Prince Street to avoid paying for the daily parking fee on your
lot. After investigating the situation it appears that this is the
case.
We wish to resolve this matter as quickly as possible, I am
therefore seeking your assistance in the matter. Please advise
your staff that my officers, with the assistance of the Durham
Regional Police, will be monitoring the situation.
It is our intention to have the by-law strictly enforced should
vehicles be found illegally parked on the street, especially in the
prohibited area. They will be ticketed and face the very real
possibility of being towed away. The fact that they work at the
hospital does not excuse them from the requirements of the by-law,
especially in view of the fact that there is a facility provided
for them at your location.
Any assistance which you can render this department will be
appreciated.

THAT Mr. Kelly be advised of the outcome of the meetings with

REPORT
On November 22, 1993, the Bowmanville Memorial Hospital's Director of
Environmental Services, Mr. Andre Hendriks wrote to the By-law Division
requesting our assistance in improving parking enforcement on the
hospital property.
At the present time, parking offences at the Hospital are handled by the
Parking Enforcement Officers and the Durham Regional Police. This
requires the Hospital to call in and ask for an officer to attend and
tag a vehicle on their lot. The guard or member of staff must then wait
until an officer arrives and co-sign the parking ticket as the agent of
the property owner. This can lead to long delays if an officer is not
readily available when the complaint comes in. The most viable solution
would be for the Hospital to take over the enforcement duties strictly
on their own property.
Attached to this report is a copy of Mr. Hendricks' letter, together
with a copy of a letter from Burns International Security Services
Limited requesting the appointment..

Once appointed by By-law the specified guards and staff members would
have the authority to issue Parking Infraction Notices on their own
property. Other municipalities have adopted this approach as it offers
the most efficient solution to very localized problems .
The By-law.Enforcement Division will provide training to the guards to
ensure that their enforcement duties are carried out properly.
It is therefore recommended that the two hospital staff members and the
four security guards listed on the letters from the Hospital and Burns
Security be appointed By-law Enforcement Officers for the sole purpose
of enforcing the Traffic By-law on the Hospital property and that the
By-law attached to Report CD-14-94 appointing these people be forwarded
to Council for approval.

Dear Mr. Creamer:
Further to our telephone conversation of November 12, 1993, the Hospital is interested
in having the security guards, our groundskeeper and Director, Engineering Services
designated as By-Law/Parking Control Officers.
I have attached a letter listing the required information from Burns Security our security
services firm.
The Hospital employees that we are interested in designating are Mr. Mel Green, Director,
Engineering Services and Mr. Frank Seymour, Groundskeeper, Engineering Services.
Their home addresses are as follows:

The main concern of the Hospital is to effectively control those areas on Hospital property
where parking violations are repeatedly occurring and could potentially have serious
implications. These areas include: the Emergency entrance, Ontario Hydro
Decontamination Unit entrance, and shipping/receiving area.

BY-LAW 94-
being a by-law to appoint certain
persons as Parking Enforcement
Officers for the Bowmanville
Memorial Hospital
WHEREAS Section 20 of the Police Services Act R.S.O. 1990, Chapter
P15, Section 15(1) authorizes a Council of any Municipality to
appoint one or more By-law Enforcement Officers who shall be Peace
Officers for the purpose of enforcing the by-laws of the
Municipality;
AND WHEREAS the Council of the Corporation of the Municipality of
Clarington deems it desirable to appoint members of the staff of
the Bowmanville .Memorial Hospital as Parking Enforcement Officers
for the sole purpose of enforcing the by-law on the property
located at 47 Liberty Street South, Bowmanville;
NOW THEREFORE the Council of the Corporation of the Municipality of
Clarington enacts as follows:
1. Those persons named on Schedule A, which is hereinafter
attached and forming part of this by-law, are hereby appointed
as By-law Enforcement Officers for the sole purpose of
enforcing the Traffic By-law of the Municipality of Clarington
on the private property of the Bowmanville Memorial Hospital
at 47 Liberty Street South, Bowmanville, Municipality of
Clarington.
