By-Law# Subject: APPROVAL OF TILE DRAINAGE LOAN APPLICATION - CANABRAE FARMS LIMITED - JOE CHRISTL, 4212 LAKESHORE ROAD, R.R. #8, NEWCASTLE, L1B 1L9 PART LOT 13 , CONCESSION BF A & B, FORMER TOWNSHIP OF CLARKE Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . THAT Report CD-23-94 be received; 2 . THAT the Tile Drainage Loan Application submitted by Joe Christl in the amount of $15, 400 be approved; 3 . THAT By-law #94-17 be rescinded; 4 . THAT the by-law attached to Report CD-23-94 be approved and forwarded, together with all necessary support documents, to the Regional Municipality of Durham for processing; and 5 . THAT Joe Christl be advised of the actions taken. BACKGROUND AND COMMENT: On January 24, 1994 , Council approved a Tile Drainage Loan Application submitted by Joe Christl in the amount of $16, 500 . The appropriate by-law (By-law #94-17) was passed by Council and all necessary documentation was forwarded to the Regional Municipality of Durham for processing. On February 16, 1994 , the Regional Municipality of Durham passed By-law #10-94 and forwarded the required documentation to the Ministry of Agriculture and Food for approval . Once the documentation was received by the Ministry, the municipality was advised that the amount eligible for loan was incorrect as the Goods and Services Tax had been included in the 6U / RECYCLED ECYCE RECYCLE ­S B PR:IHED U4 RECYCLED PAPER Report CD-23-94 - 2 - July 4, 1994 calculations . The reason for this is that farmers are eligible for a full GST rebate and, therefore, this item should not be included on the the loan. The ministry also advised that the application would need to be resubmitted, but that we would have to wait until the budget was known for the 1994/95 fiscal year. On June 15, correspondence was received stating that the budget for the program has been set at $10 . 8 million. Mr. Christl' s application has been held in abeyance, awaiting confirmation from the ministry. It is now appropriate to continue with the processing of the application. Once the GST amount is backed out from the calculation, the loan amount is $15, 400 . In order to proceed, it will be necessary for By-law #94-17 to be rescinded, a new by-law to be passed, and all documentation forwarded to the Regional Municipality of Durham for processing. After consulting with the ministry and the Region, it has been determined that Mr. Christl' s application can be completed by August 1994 . Respectfully submitted, Reviewed by, .
