Subject: PROPERTY COMPLAINT - VAN HAMBURG
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report CD-5-93 be received; and
2 . THAT a copy of Report CD-5-93 be forwarded to Mr. and Mrs . Sheehan.
1. BACKGROUND:
1. 1 Earlier this year the By-law Enforcement Division received
complaints concerning the establishment of a transport depot on
Regional Road #57, north of Taunton Road. This matter was also
brought to Council's attention by Mr. & Mrs . Sheehan's letter of
April 18, 1993 .
1.2 Inspection of the site, located at 5655 Regional Road #57 showed
that a large area to the south of the home had been cleared of
trees and bulldozed, gravel had been dumped on the lot and
levelled to create a parking/storage area. At the time of the
inspection there were three transports parked on site along with
a bulldozer, fuel tanks and several cars and trucks .
2. COMNENTS:
2 . 1 The property is owned by Ed and Anne Van Hamburg. The land is
zoned "Agricultural" . As such, a transport depot is not a permitted
use.
2 . 2 The Zoning By-law does permit the parking of two commercial
vehicles on an agricultural lot, however, the vehicles must be for
uses incidental to a permitted use.
2 . 3 A check with the Durham Region Public Works Department revealed
that an entrance permit was obtained for the driveway and culvert.
The permit was issued based on an application which indicated it
was to be for residential use. The application states clearly
"for non commercial use only" .

The Regional Works Department will have to decide what, if any,
action they intend to take in regards to this matter.
2 .4 On May 4, 1993 a letter was sent by registered mail to the owners
advising them of the illegality of the situation and instructing
them to cease operations within thirty days . If steps have not
been taken to correct the problem by then, legal action will be
initiated by the By-law Division pursuant to the provisions of
the By-laws .
2 .5 It is staff's intention to keep Council advised of any progress
made in resolving the matter.

I wish to ob3ect to the deterioration of the land owned
by Mr . Ed Van Hamburg, at RR 01 Bowmanville on East side Just
north of our property on Durham Road # 57.
We have called City Hall several times and were told
there were complaints and there was a "Stop work order" on
it . NOTHING has stopped up there ! Trucks are still pulling
In at all hours , via a driveway that , to my knowledge, was
never approved .
We have great concerns ,with regard to the above change .
- close calls with traffic because of wide
trucks .
- confused passing by vehicles not prepared for trucks
turning in.
- exposed gas tanks .
- desecration of agricultural land .
- disregard for zoning bylaws by constructing additional
driveway.
It seems unfair that some people can have such a
disregard for the laws of zoning and permits .
Please be advised that we wish to be informed as to what
is and will be happening to the above mentioned property as
It most certainly effects the surrounding properties as well .
