Subject: AUTHORIZATION TO PERMIT ORGANIZATIONS TO SELL BREAK-OPEN
LOTTERY (NEVADA) TICKETS IN THE TOWN OF NEWCASTLE
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report CD-24-92 be received;
2 . THAT the Licensing Officer (Town Clerk) be authorized to
issue a letter of permission for the sale of break-open
tickets where the organization has been issued a licence
from the Ministry of Consumer and Commercial Relations; and
3. THAT Sandy Flynn, Big Sisters N.O.W. , be advised of
Council's decision.
BACKGROUND AND COMMENT:
On June 8, 1992, Council considered Addendum to Report CD-11-92
and adopted the following recommendations:
"THAT Report CD-11-92 be received;
THAT the request received from Sandy Flynn, Promotions
Co-Ordinator, Big Sisters, N.O.W. , for approval of a licence
for the sale of Break-Open Lottery (Nevada) Tickets, be
denied on the basis that the Town of Newcastle is not the
home based municipality of this organization;
THAT the Lottery Licensing Officer (Town Clerk) be directed
to deny all requests for Break-Open Tickets (Nevada)
Licences, if the applicant organization is not based in the
Town of Newcastle, until such time as the Lotteries Branch
of the Ministry of Consumer and Commercial Relations amends
its policy in this regard; and
THAT Sandy Flynn be advised of Council's decision and she be
forwarded a copy of Report CD-11-92 . 11

A recent change in Ministry licensing policies has provided
organizations with a demonstrated provincial mandate, the
opportunity to sell break open tickets from more than one
municipality in the Province. The criteria used to determine
status as a provincially mandated organization include:
1. A reference to a provincial mandate within the letters of
incorporation;
2 . A Board of Directors which is representative of a number of
different areas across the Province; and
3 . An ability to provide direct services to a number of
different communities and regions across the province
(usually through regional or local chapters of the
organization) so that the services provided are available
and accessible to a significant portion of the residents
within the Province.
A provincially-mandated organization must first apply to the
Ministry of Consumer and Commercial Relations for the issuance of
a licence, then request a letter of permission from the local
municipality. In order for the licence to be valid, the
municipality's letter must be posted at the location where
tickets are being sold.
Because of these new Provincial Guidelines, it is respectfully
recommended that the Lottery Licensing Officer (Town Clerk) be
authorized to issue a letter of permission for the sale of break-
open tickets where the organization has been issued a licence
from the Ministry of Consumer and Commercial Relations .
