Subject: MUNICIPAL ELECTIONS ACT SUPPLEMENTARY STATEMENT
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report CD-27-92 be received for information.
BACKGROUND AND COMMENT:
On July 20, 1992, Council received Report CD-22-92, outlining the
Clerk's Statement of Candidates Disclosure for the 1991 Municipal
Elections .
This statement indicated that three individuals, i.e. , Corinne Allin
(School Board Trustee - Ward 3) , Robert Burke (Separate School Board
Trustee) and Monte Hennessy (Local Councillor - Ward 1) had not complied
with the Municipal Elections Act by failing to file a financial
statement by June 30, 1992 .
In accordance with the Municipal Elections Act, Section 132 (6) (7) ,
demand notices were sent to the three individuals by registered mail on
July 3, 1992 . Also, in accordance with Section 132 (8) of the Act, the
notice of non-compliance was posted in two conspicuous places in the
municipality and published in the newspapers having general circulation.

The demand notice states that the registered candidate, if elected,
shall forfeit the office and, whether elected or not, shall be
ineligible to hold any office up to and including the next regular
election if the candidate fails to file a statement within 30 days of
the date of the notice.
Attached hereto is a copy of the Supplementary Statement filed under
Section 132 (9) of the Municipal Elections Act. As shown on the
statement, Corrine Allin and Robert Burke filed their statement of
election finances within the 30 day period of the notice of demand.
Monte Hennessy failed to file his statement within the specified time
frame and is, therefore, ineligible to hold any office in the Town of
Newcastle up to and including the 1994 Municipal Elections.
