The Cemetery was not included in the list of abandoned cemeteries when By-law 77-25 was passed on April 18, 1977, and at a meeting held on November 26, 1990, the Clarke Pioneer Cemetery Board passed a motion requesting that the error be corrected at this time. Section 62 of the Cemeteries Act states that the Council of a local municipality shall maintain a cemetery where an owner cannot be found or is unable to maintain it and the municipality shall be deemed to be the owner of the cemetery. Although Section 62 does not necessitate the passage of a by-law, it is advisable that a by-law be passed as recognition of the municipality's responsibility in the matter. It is, therefore, recommended that the Town accept responsibility of maintenance of the Billings ' Cemetery and that the appropriate by-law be passed.
