CARE AND MAINTENANCE OF THE BILLINGS' CEMETERY
FORMER TOWNSHIP OF CLARKE
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report CD-5-91 be received;
2 . THAT the Billings ' Cemetery located in Part Lot 25,
Concession 9, former Township of Clarke, be added to the
Town of Newcastle's Inventory of Abandoned Cemeteries;
3 . THAT the Clarke Pioneer Cemetery Board be requested to
assume the responsibility for the future maintenance of the
abandoned cemetery;
4 . THAT the Clarke Pioneer Cemetery Board be authorized to
undertake any remedial works required to bring the cemetery
lands into conformity with standard levels of maintenance
appropriate to such lands;
5 . THAT Council enact the necessary by-law to add the lands to
the Town's Abandoned Cemetery Inventory; and
6 . THAT the by-law attached to Report CD-5-91 be approved and a
copy forwarded to the Ministry of Consumer and Commercial
Relations for information.

BACKGROUND AND COMMENT:
At a meeting held on December 10, 1990, Council received a
request from the Secretary of the Clarke Pioneer Cemetery Board
for the Trusteeship of the Billings ' Cemetery to be relinquished
to the Town of Newcastle. The Cemetery was not included in the
list of abandoned cemeteries when By-law 77-25 was passed on
April 18, 1977, and at a meeting held on November 26, 1990, the
Clarke Pioneer Cemetery Board passed a motion requesting that the
error be corrected at this time.
Section 62 of the Cemeteries Act states that the Council of a
local municipality shall maintain a cemetery where an owner
cannot be found or is unable to maintain it and the municipality
shall be deemed to be the owner of the cemetery. Although
Section 62 does not necessitate the passage of a by-law, it is
advisable that a by-law be passed as recognition of the
municipality's responsibility in the matter.
It is, therefore, recommended that the Town accept responsibility
of maintenance of the Billings ' Cemetery and that the appropriate
by-law be passed.
