HomeMy WebLinkAboutCD-6-91 {rr ✓f V TOWN OF NEWCASTLE �- REPORT r, File # Res. # By-Law # MEETING: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE DATE: FEBRUARY 18, 1991 REPORT #: CD-6-91 FILE #: SOg,JECT: NEVADA LOTTERY TICKET LICENSING RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report CD-6-91 be received; 2 . THAT the request of Glenn Pearson, Nevadaman, for an exemption from certain sections of Form BOIL-TC, Nevada Lottery Ticket Licensing be denied; and 3 . THAT Glenn Pearson be advised of Council's decision. BACKGROUND AND COMMENT: On October 15, 1990, Council referred correspondence to the Clerk from Glenn Pearson, Sales Representative, Nevadaman, wherein he requested that the Town of Newcastle grant an exemption to terms and conditions under which break-open ticket licences may be issued. The Sections of the Conditions which Mr. Pearson is concerned with are as follows: (3) A Break-Open Ticket Licence shall only be issued to a charitable or religious organization which owns or regularly occupies premises at which tickets will be offered for sale; �� �� Continued . . . . .-2 Report CD-6-91 - 2 - February 18, 1991 (4) (b) The designated location specified pursuant to this section shall not be a public, commercial, retail location, nor a location licenced by the L.L.B.O. as a public tavern or beverage room; and ( 17) (b) The actual handling or selling of tickets shall not be delegated to any organization, company, entity, or to any other person who is not a bonafide member of the licencee. On March 6, 1987, the then Minister of Consumer and Commercial Relations issued a directive authorizing municipal councils to, in their own discretion, grant an exemption to the requirements of the above Sections provided that: (a) the licence applicant cannot meet the requirements of Section 3; or (b) the licence applicant meets the requirements of Section 3 but it is impractical to sell tickets from that location; (c) the sale of tickets is limited to ONE location only; and (d) all other sections of the terms and conditions are complied with. Mr. Pearson has advised that he has had several organizations indicate an interest to him in this regard (Kinsmen, Kinettes and Brownsdale Community Centre to name a few) . In speaking with a representative of the Licensed Gaming Investigations and Enforcement Branch of the Ministry of Consumer and Commercial Relations, I was advised that the organization, not the distributor of the break-open tickets, should be applying for the exemption. The Ministry stated that each and every organization wishing an exemption should apply to the municipality and each application considered on its own merits . In this case, Mr. Pearson, who is the distributor of the break- open tickets, has requested the exemption. The Ministry representative indicated that the ticket distributors are aware that they should not be approaching the municipalities on behalf of the organizations and was, in fact, going to contact Nevadaman to ascertain why they have done so in this case.
