RECOMMENDATIONS:
It is respectfully recommended that Council approve the following:
1. THAT Report CLD-29-04 be received;

BACKGROUND
On May 13, 2004 the Animal Services Division received a copy of a Durham Regional Police
Report of a dog bite incident that had occurred on May 7, 2004, The officer indicates that Mr,
VanDam stated that at approximately 9:00 p.m., a black lab belonging to the owners of 10308
Old Scugog Road bit him in the left arm. Mr, VanDam went to the hospital as a result of the
bite.
Mr, VanDam reports that at approximately between 6:00 p,m. and 7:00 p.m, he was walking to
visit a neighbour when a black dog came around the corner of the barn and lunged towards his
throat. He raised his arm to try to protect himself, falling on his back, In the meantime, the
dog was still biting his leg. After the incident, he watched the black dog walk over to his dog
house. He then approached the dog owner and advised that the dog had just bitten him.
Mr. VanDam went to Bowmanville Hospital following the incident.
An Order to Restrain was issued to Tracey Bouillon on June 3, 2004. The order requires Ms,
Bouillon to:
1. licence and register the dog with the Clarington Animal Shelter and have the dog
permanently identified by microchip implantation;
2, notify the Animal Shelter staff immediately upon relocating the dog or upon transferring
ownership of the dog;
3, restrain the dog at all times, while the dog is on its own property, by keeping it enclosed
in a pen or other enclosure in such a manner as to prevent the dog from leaving the
property and to prevent contact with people and other animals; and
4. restrain the dog at all times, while the dog is off its own property, with the use of a
muzzle and a leash no longer than 6 feet and under the care and control of a person
who is 16 years of age or older.
Ms, Bouillon has filed an appeal to the Order, claiming discrepancies in the various accounts of
the incident. Ms, Bouillon's letter of appeal is attached hereto as Attachment No.1.

Dear Patti Barrie:
On Monday, June 14, 2004, I am having major back
surgery and will be hospitalized for approx. 2 weeks, Upon
my return home I will be unable to sit or stand for long
periods of time. Before you read my appeal letter, I
am requesting my appeal before council to be postponed
until August so that I may recover enough to come to the
meeting and appeal the permanent restraint on my dog,
Riley, Thank you,
This letter is to appeal the permanent restraint
placed on my dog, Riley for an alleged dog bite that took
place on Friday, May 7, 2004 on Glen Vandam in the town of
Burketon, Ontario. (ORDER # 08-2004). As I have previously
claimed, my dog is INNOCENT, Riley was deemed guilty and
convicted and no one ever asked for our side of the story,
I am appealing this restraint for the following reasons:
1) On Friday, May 7 at approx, 10:00pm, Mr, Vandam called
over to my husband and claimed he has just been bitten by
my black lab, Riley, Riley was in the garage. When I
questioned Mr, Vandam as to when the incident occurred he
responded, "about 15 minutes ago," Fifteen minutes earlier
my dog was in the house with myself and my daughter.
2) Mr, Vandam reported to Public Health Inspector, Jessica
lng, that the dog bite occurred between 5 and 7 pm, but
called over to us at 10:00pm that he "had just been bitten
by our dog,
3) Mr. Vandam also reported to Tracy Yuzwa, Animal Services
Officer, that he had been bitten on his hand. When Tracy
asked me what hand Mr, Vandam told me he had been bitten on
I clearly told her that he dropped his pants to my
husband and pointed to a scratch on his left thigh,
claiming that was where our dog had bit him,
4)Mr. Vandam does not live anywhere near our house, He
reports watching the dog run into our yard. How can he
clearly identify a black dog at 10:00 at night (in the
dark)two houses away?
5)There are several dogs that run loose in our
neighbourhood, and there are (2) other black labs that look
identical to ours, (I have neighbours that can attest to
that), One of the labs is so identical to ours that both
my >husband and I have mistaken it for Riley, We have
taken a picture of the loose black lab roaming around
behind the barn where Glen claims he was bitten, For the
record, this dog growls and growled at our son.
My family and my dog Riley have all been punished
enough for something he did not do, I have two small
children and would not put them at risk if I knew Riley was
in any way vicious, Please read clearly all of the above
and maybe you will realize maybe the accuser should be
looked into a little more,
