Subject: OFFENCE PROVISIONS OF VARIOUS TOWN BY-LAWS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report CD-16-91 be received; and
2 . THAT the by-laws attached to Report CD-16-91 be forwarded to
Council for passage.
BACKGROUND AND COMMENT:
The Town Solicitor has advised staff that it is no longer necessary, or
desirable, to specify the maximum amount of a fine for violation of a
by-law passed under the Municipal Act in the by-law itself. The Senior
By-law Enforcement Officer has assembled a list of by-laws which he is
frequently called upon to enforce, and which require updating. This
list is as follows:
- License, regulate and govern auctioneers
- License and regulate transient traders
- Prohibit sales by retail on highways or on vacant lots
- Regulate the clothing of persons employed in food or drink
establishments
- Regulate the hours of closing of barber shops
- Prohibit and regulate the discharge of guns or other firearms, air
guns and spring guns
- Prevent hazards to children from unused and unsafe refrigerators
and other similar containers
- License, regulate and govern vehicles from which refreshments are
sold
- Regulate the parking, standing and stopping of vehicles on highways
and on private and municipal properties
- License, regulate and govern taxi drivers, brokers and taxi vehicle
owners, buses, motor and other vehicles used for hire
- License, regulate and govern the operation of tourist camps
- Removal of snow and ice

- Respecting the deposit of and retention of certain waste on lands
in the Town of Newcastle
The offence provisions of the by-laws in question could be amended by
the passage of one by-law, however, this would prove to be cumbersome in
the future for indexing purposes .
It is, therefore, recommended that the amending by-laws attached hereto
and listed as Attachments 1 through 18 inclusive, be forwarded to
Council for passage.

being a by-law to amend By-law Number 80-86
respecting smoking
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend By-law Number 80-86;
NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. By-law Number 80-86 is hereby amended by deleting Section 32
in its entirety and replacing it with a new Section 32 as
follows:
"32. Any person who contravenes the provisions of this
by-law is guilty of an offence. "; and

2. This by-law shall come into full force and effect
immediately on the final passing of it.

to regulate the hours of closing of
barber shops
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend By-law Number 72-25;
NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. By-law Number 72-25 is hereby amended by deleting Section 4
in its entirety and replacing it with a new Section 4 as
follows:
"4. Any person who contravenes the provisions of this
by-law is guilty of an offence. "; and
2. This by-law shall come into full force and effect
immediately on the final passing of it.

WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend By-law Number 70-18;
NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. By-law Number 70-18 is hereby amended by deleting Section 3
in its entirety and replacing it with a new Section 3 as
follows:
"3. Any person who contravenes the provisions of this
by-law is guilty of an offence. "; and
2. This by-law shall come into full force and effect
immediately on the final passing of it.

deems it advisable to amend By-law Number 74-54;
NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. By-law Number 74-54 is hereby amended by deleting Section 6
in its entirety and replacing it with a new Section 6 as
follows:
"6. Any person who contravenes the provisions of this
by-law is guilty of an offence. "; and
2. This by-law shall come into full force and effect
immediately on the final passing of it.

WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend By-law Number 83-150;
NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. By-law Number 83-150 is hereby amended by deleting
Paragraph 5 in its entirety and replacing it with a new
Paragraph 5 as follows:
"Any person who contravenes the provisions of this
by-law is guilty of an offence. "; and
2. This by-law shall come into full force and effect
immediately on the final passing of it.

WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend By-law Number 87-114;
NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. By-law Number 87-114 is hereby amended by deleting Section 3
in its entirety and replacing it with a new Section 3 as
follows:
"3. Any person who contravenes the provisions of this
by-law is guilty of an offence. "; and
2. This by-law shall come into full force and effect
immediately on the final passing of it.

deems it advisable to amend By-law Number 79-19;
NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. By-law Number 79-19 is hereby amended by deleting Section 4
in its entirety and replacing it with a new Section 4 as
follows:
"4. Any person who contravenes the provisions of this
by-law is guilty of an offence. "; and
2. This by-law shall come into full force and effect
immediately on the final passing of it.

WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend By-law Number 80-82;
NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. By-law Number 80-82 is hereby amended by deleting Section 6
in its entirety and replacing it with a new Section 6 as
follows:
"6. Any person who contravenes the provisions of this
by-law is guilty of an offence. "; and
2. This by-law shall come into full force and effect
immediately on the final passing of it.

WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to further amend By-law Number 79-144;
NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. By-law Number .79-144 is hereby amended by deleting Section 9
in its entirety and replacing it with a ',gew Section 9 as
follows:
"9. Any person who contravenes the provisions of this
by-law is guilty of an offence. "; and
2. This by-law shall come into full force and effect

deems it advisable to amend By-law Number 91-58;
NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. By-law Number 91-58 is hereby amended by deleting Section 25
in its entirety and replacing it with a new Section 25 as
follows:
"25. Any person who contravenes the provisions of this
by-law is guilty of an offence. "; and
2. This by-law shall come into full force and effect
immediately on the final passing of it.

NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. By-law Number 87-197 is hereby amended by deleting Section
11 in its entir6ty and replacing it with a new Section 11 as
follows:
"11. Any person who contravenes the provisions of this
by-law is guilty of an offence. "; and
2. This by-law shall come into full force and effect

1. By-law Number 90-160 is hereby amended by deleting Section 7
in its entirety.,and replacing it with a new Section 7 as
follows:
