Roche RECOMMENDATIONS: It is respectfully recommended that the General Purpose & Administration Committee recommend to Council the following: 1. THAT Report CD-2-90 be received; 2 . THAT the Mayor and Clerk be authorized to execute the appropriate by-laws; and 3 . THAT the Clerk be authorized to carry out all actions necessary to complete the process of property designation pursuant to the Ontario Heritage Act, 1974, and detailed within Report CD-2-90 . BACKGROUND AND COMMENT: On March 28, 1989, Council adopted the Report of the General Purpose and Administration Committee, which dealt with the designations of the subject properties . As detailed in Report PD-81-89 , the Clerk was authorized to proceed with the designating of the subject properties as historic properties . Continued. . . . . /2 601 REPORT CD-2-90 - 2 - January 22, 1990 The following actions were carried out: 1. By letters dated March 29, 1989, the property owners were requested to signify in writing, that they were prepared to undertake the designating of their properties . The consent forms have now been executed. 2 . Notice of Intention to Designate was forwarded to the owners of the properties and to the Ontario Heritage Foundation by Registered Mail on October 31, 1989 . The Notice of Intention to Designate was published in the local newspapers, once each week for three successive weeks - October 25, November 1, and November 8, 1989 . 3 . By-laws to designate the properties .pursuant to the Ontario Heritage Act, 1974, were prepared. The period for filing objections to the proposed designations ended on November 24, 1989 . No objections were filed either during or subsequent to the objection period. Having regard to the fact that no objections have been filed to the designating of the properties and the owners have consented to the designating, it is appropriate that the following actions now be undertaken: 1 . THAT the by-laws to designate the properties be recommended to Council for passage; 2 . THAT the Clerk be authorized to publish Notices of Designation in the newspapers and forward a certified copy of the by-laws to the property owners and to the Ontario Heritage Foundation; 3 . THAT a copy of the by-laws designating the properties be forwarded to the Town's Solicitor for registration on title so that future owners and anyone else that may be interested in the properties will be aware of the fact that they have been designated; and 4 . THAT the Local Architectural Conservation Advisory Committee be advised that the properties have been designated. Towp7Clerk Chief A .n%strative Officer 602 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 90- being a by-law to designate the property municipally known as "The Guy Gamsby House", located at 5085 Main Street, Orono, Hanning Plan, Block D, Lot 16, former Township of Clarke, now in the Town of Newcastle, Regional Municipality of Durham, as a property of architectural and historical value and interest which property is more particularly described in Schedule A attached WHEREAS the Ontario Heritage Act, 1974, authorizes the Council of a municipality to enact by-laws to designate real property including all the buildings and structures thereon to be of architectural and historical interest; and WHEREAS the Council of the Corporation of the Town of Newcastle has caused to be served upon the owner of the lands and premises known as 5085 Main Street, Hanning Plan, Block D, Lot 16, former Township of Clarke, now in the Town of Newcastle and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property and has caused such notice of intention to be published in the Canadian Statesman, Newcastle Independent, and the Orono Times, newspapers having general circulation in the area of the designation, once each week for three consecutive weeks, namely, October 25, November 1, and November 8, 1989; and WHEREAS "The Guy Gamsby House" located at 5085 Main Street, Hanning Plan, Block D, Lot 16, former Township of Clarke, has a very significant architectural value of interest to the Town of Newcastle and its people in that the house was built c. 1850 and is a rare example of the late Georgian Style, with its symmetrical facade (5 bays wide on the first floor, and 3 bays wide on the second) , its 6 over 6 sash, and finely moulded cornices, and has not undergone any 20th Century modifications which have drastically altered many of the surviving frame houses in the Township. The house retains the following architectural features: the original clapboard siding, cornices and most of the 6 over 6 sash; the moulded pilasters and entablature and the sidelights and transom surrounding the front door, particularly the delicate rectilinear glazing of the transom; the original pine floors, wainscotting and window trim; and the finely wrought banister of the main entrance hall and simple decorative carving on the main staircase; and WHEREAS the Local Architectural Conservation Advisory Committee of the Town of Newcastle has recommended that the property "The Guy Gamsby House", 5085 Main Street, Hanning Plan, Block D, Lot 16, former Township of Clarke, now in the Town of Newcastle, Regional Municipality of Durham, be designated under the terms of the Ontario Heritage Act; and WHEREAS no notice of objection to the proposed designation has been served upon the Clerk of the Municipality; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1. There is designated as being of Architectural and Historical value of interest, the real property known municipally as "The Guy Gamsby House", 5085 Main Street, Hanning Plan, Block D, Lot 16, Township of Clarke, Regional Municipality of Durham. 2. Hanning's Plan of the Former Village of Orono, Geographic Township of Clarke, now within the limits of the Town of Newcastle. 605 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 90- being a by-law to designate the property municipally known as 81 Scugog Street, Hanning Plan, Block 6, Part Lot 1, former Town of Bowmanville, now in the Town of Newcastle, Regional Municipality of Durham, as a property of architectural and historical value and interest which property is more particularly described in Schedule A attached WHEREAS the Ontario Heritage Act, 1974, authorizes the Council of a municipality to enact by-laws to designate real property including all the buildings and structures thereon to be of architectural and historical interest; and WHEREAS the Council of the Corporation of the Town of Newcastle has caused to be served upon the owner of the lands and premises known as 81 Scugog Street, Hanning Plan, Block 6, Part Lot 1, former Town of Bowmanville, now in the Town of Newcastle and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property and has caused such notice of intention to be published in the Canadian Statesman and the Newcastle Independent, newspapers having general circulation in the area of the designation, once each week for three consecutive weeks, namely, October 25, November 1, and November 8, 1989; and WHEREAS 81 Scugog Street, Hanning Plan, Lot 6, Part Lot 1, former Town of Bowmanville, has a very significant architectural value of interest to the Town of Newcastle and its people in that it dates from c. 1880, and originally stood at the corner of Concession and Prospect Streets and was moved to its present location in 1912. The symmetrical facade features a projecting central bay which retains three round headed windows and which is topped by a triangular gable and the exterior of the house retains a number of features reminiscent of the second empire style, namely: the brick work, executed in the running bond style, is highlighted by polychromatic trim over the front windows and there are two separate courses of decorative banding in black brick; the original sash, particularly the round headed windows in the projecting bay; the front gable retains the original gingerbread; the original eaves brackets are intact; and the twin verhandahs flanking the central bay remain. The interior of the house which had been divided into apartments has been restored to its original centre hall plan and the following interior elements have survived: the plaster border of the parlor ceiling, the border and central moulding of the dining room, and the plaster angels at the bases of the arch in the front entrance hall; the winding banister of the main staircase with its original spindles and handsome newel post; the etched ruby glass transom over the front door; the original sponge graining which remains in much of the house; the wooden mantel piece and surmounting mirror of the parlor fireplace; the original pine and hardwood floors; and the moulded window trim and baseboards; and WHEREAS the Local Architectural Conservation Advisory Committee of the Town of Newcastle has recommended that the property 81 Scugog Street, Hanning Plan, Block 6, Part Lot 1, former Town of Bowmanville, now in the Town of Newcastle, Regional Municipality of Durham, be designated under the terms of the Ontario Heritage Act; and WHEREAS no notice of objection to the proposed designation has been served upon the Clerk of the Municipality; 2 606 - 2 - NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1. There is designated as being of Architectural and Historical value of interest, the real property known municipally as 81 Scugog Street, Hanning Plan, Block 6, Part Lot 1, former Town of Bowmanville, Regional Municipality of Durham. 2. MAYOR CLERK 607 SCHEDULE A TO BY-LAW 90- ALL AND SINGULAR that certain parcel or tract of land or premises situate lying and being in the Town of Bowmanville in the County of Durham and Province of Ontario, a part of original Township Lot No. 12 in the 2nd Concession, being composed of part of Lot No. 1 in block No. 6 on the east side of Scugog Street according to a plan of the said Town of Bowmanville made by C.G. Hanning P.L.S. , dated the 30th day of June, 1869, which plan is in the Registry Office for the Registry Division of the West Riding of the County of Durham more particularly described as follows: COMMENCING at a point on the east side of Scugog Street which is distant therein northerly 45 feet from the point where the north side of O'Dell Street intersects the east side of Scugog Street; THENCE northerly along the east limit of Scugog Street 53 feet; THENCE easterly and parallel with O'Dell Street 132 feet; THENCE southerly parallel with Scugog Street 53 feet; THENCE westerly parallel with O'Dell Street 132 feet to the Place of Beginning and being all of said Lot Number 1 in Block No. 6 belonging to the said Grantor. As described in Instrument No. 135939. 6 0 8 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 90- being a by-law to designate the property municipally known as "The John Cobbledick House" located at R.R. #1, Orono, Lot 27, Concession 5, former Township of Clarke, now in the Town of Newcastle, Regional Municipality of Durham, as a property of architectural and historical value and interest which property is more particularly described in Schedule A attached WHEREAS the Ontario Heritage Act, 1974, authorizes the Council of a municipality to enact by-laws to designate real property including all the buildings and structures thereon to be of architectural and historical interest; and WHEREAS the Council of the Corporation of the Town of Newcastle has caused to be served upon the owner of the lands and premises known as R.R. #1, Orono, Lot 27, Concession 5, former Township of Clarke, now in the Town of Newcastle and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property and has caused such notice of intention to be published in the Canadian Statesman, the Newcastle Independent, and the Orono Times, newspapers having general circulation in the area of the designation, once each week for three consecutive weeks, namely, October 25, November 1, and November 8, 1989; and WHEREAS "The John Cobbledick House", located at R.R. #1, Orono, Lot 27, Concession 5, former Township of Clarke, has a very significant architectural value of interest to the Town of Newcastle and its people in that it dates from c. 1865 and is a fine representative example of a fieldstone farmhouse typical of many of those built in Clarke and Darlington Townships between 1850 and 1870. The design of this 1-1/2 storey house, with its three bay wide symmetrical facade, is based on the Georgian tradition, however, its eaves, returns and beautifully moulded cornices are examples of detailing in the Greek Revival style. The front of the house is laid in random coursed fieldstone and the sides and rear wall are in rubble fieldstone. The front entrance is surrounded by a rectangular transom and sidelights and all of the windows are finished with stone voussoirs. Features of particular note are as follows: the interesting combination of coursed and rubble fieldstone construction making it a good example of the stone masonry of this Township in the mid 19th century; the front wall of the house retains much of the original beaded mortar; the detailing of the cornices and of the returns in the gable ends of the house is particularly well executed; and the front entrance retains its original pilasters and moulded entablature; and WHEREAS the Local Architectural Conservation Advisory Committee of the Town of Newcastle has recommended that the property "The John Cobbledick House", R.R. #1, Orono, Lot 27, Concession 5, former Township of Clarke, now in the Town of Newcastle, Regional Municipality of Durham, be designated under the terms of the Ontario Heritage Act; and WHEREAS no notice of objection to the proposed designation has been served upon the Clerk of the Municipality; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1. MAYOR CLERK 610 SCHEDULE A TO BY-LAW 90- ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Newcastle, Regional Municipality of Durham, Province of Ontario, and being composed of all that portion of the original allowance for road lying between Lots Twenty-six (26) and Twenty-seven (27) in the Fifth Concession of the Geographic Township of Clarke, formerly in the County of Durham, more particularly designated as Part Thirteen (13) according to Plan 10 R 919, deposited in the Land Registry Office for the Registry Division of Newcastle (#10) on January 17, 1979. 611 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 90- being a by-law to designate the property municipally known as 76 Queen Street, Town Lot 9, Block U, former Town of Bowmanville, now in the Town of Newcastle, Regional Municipality of Durham, as a property of architectural and historical value and interest. WHEREAS the Ontario Heritage Act, 1974, authorizes the Council of a municipality to enact by-laws to designate real property including all the buildings and structures thereon to be of architectural and historical interest; and WHEREAS the Council of the Corporation of the Town of Newcastle has caused to be served upon the owner of the lands and premises known as Town Lot 9, Block U, former Town of Bowmanville, now in the Town of Newcastle and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property and has caused such notice of intention to be published in the Canadian Statesman and the Newcastle Independent, newspapers having general circulation in the area of the designation, once each week for three consecutive weeks, namely, October 25, November 1, and November 8, 1989; and WHEREAS 76 Queen Street, Town Lot 9, Block U, former Town of Bowmanville, has a very significant architectural value of interest to the Town of Newcastle and its people in that the cottage, dating from c. 1860 is a fine example of the hip roofed Regency cottage. It boasts a five bay wide facade rather than the more common three bay arrangement found in most cottages of this type. The steeply pitched gables of both the south and east sides contain small windows. Of particular note are the following architectural features: the well preserved brick work in the common bond pattern; the segmentally arched windows of the ground floor; the substantial porch at the front entrance which retains its moulded pillars and finely turned spindles, and the triangular cornice of which echoes the peak of the front gable; and the transom over the front door and the ruby glass sidelights. Interior features of the cottage which are of particular note are as follows: the original pine and hardwood floors; and the baseboard and window trim, the detailing of which, interestingly, vary subtly from one room to the next; and WHEREAS the Local Architectural Conservation Advisory Committee of the Town of Newcastle has recommended that the property 76 Queen Street, Town Lot 9, Block U, former Town of Bowmanville, now in the Town of Newcastle, Regional Municipality of Durham, be designated under the terms of the Ontario Heritage Act; and WHEREAS no notice of objection to the proposed designation has been served upon the Clerk of the Municipality; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1. There is designated as being of Architectural and Historical value of interest, the real property known municipally as 76 Queen Street, Town Lot 9, Block U, former Town of Bowmanville, Regional Municipality of Durham. 2. The Municipal Solicitor is hereby authorized to cause a copy of this by-law to be registered against the property described in the preceeding paragraph. 2 612 - 2 - 3.
