SUBJECT: RE-ARRANGEMENT OF GRAVESTONES - ADVENT CEMETERY,
LOT 26, CONCESSION 5, FORMER TOWNSHIP OF DARLINGTON
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report CD-20-90 be received;
2 . THAT Council approve the request of the Darlington Cemetery
Board to re-arrange the gravestones at the Advent Cemetery
into a cairn and the necessary by-law be forwarded to Council
for approval;
3. THAT the subject by-law be forwarded to the Ministry of
Consumer and Commercial Relations for approval;
4 . THAT the necessary funds for the project be drawn from the
Contingency Account #7007-00000-0298; and
5. THAT the Darlington Cemetery Board be advised of Council's
decision.
BACKGROUND AND COMMENT:
On May 31, 1990, a request was received from the Darlington
Cemetery Board for Council's permission to re-arrange the
gravestones into a cairn in the Advent Cemetery, Lot 26, Concession
5, former Township of Darlington.

Section 65( 1) (e) of The Cemeteries Act states that the Council of
every local municipality may pass by-laws for the maintenance,
management, regulation and control of any cemetery that is owned
by the Corporation. Section 65(2) indicates that this authority
includes authority to provide for the removal or re-arrangement of
any monument, gravestone or other structure in any cemetery that
the municipality has been charged with maintaining.
The Advent Cemetery is included on the inventory of Abandoned
Cemeteries listed in Schedule "A" of By-law 77-25 (See attached)
and has been maintained by the Darlington Cemetery Board since the
passing of the by-law on April 18, 1977 . The request to re-
arrange the gravestones into a cairn, has been received from the
Board to allow for proper maintenance of the grounds .
The Cemetery Board anticipates the cost of the project to be
approximately $3,000 . 00 . The Treasurer has indicated that the
funds are available in the Contingency Account #7007-00000-0298.
In order to accommodate the request of the Darlington Cemetery
Board, staff is recommending that a by-law be passed by the Council
of the Town of Newcastle authorizing the re-arrangement of the
gravestones . In accordance with Section 65(3) of The Cemeteries
Act, the by-law will not come into effect until it has been
approved, in writing, by the Ministry of Consumer and Commercial
Relations .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 90-
being a by-law to re-arrange monuments,
markers, gravestones or other structures
in the Advent Cemetery, Lot 26, Concession
5, former Township of Darlington
WHEREAS the Advent Cemetery, situated in Lot 26, Concession 5,
former Township of Darlington, now in the Town of Newcastle, has
been taken over by the Town in accordance with The Cemeteries Act,
R.S.O. 1980, C.59, Section 62;
AND WHEREAS it has been found expedient for the proper maintenance
of the grounds, that the monuments, markers or other structures in
the cemetery should be moved and re-erected in a central location;
NOW THEREFORE BE IT RESOLVED THAT THE COUNCIL OF THE CORPORATION
OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS:
1. THAT, in accordance with Section 65(2) of The Cemeteries Act,
R.S.O. 1980, C.59, the monuments, markers or other structures
located in the Advent Cemetery, shall be re-arranged as shown
on Schedule "A" attached hereto.
2. THAT this by-law shall come into force on the date that it is
approved by the Ministry of Consumer and Commercial Relations
in accordance with Section 65(3) of The Cemeteries Act, R.S.O.
1980, C.59.
