REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE FOR THE
MEETING HELD ON OCTOBER 12, 1982.

SUBJECT: ESTABLISHMENT OF PIT AND QUARRY RESERVE ACCOUNT
RECOMMENDATION:
It is respectfully recommended:
1 . That this report number TR-59-82 be received; and
2. That the attached by-law to establish a Pit & Quarry Reserve
be approved, and forwarded to Council .
BACKGROUND:
For the past number of years, the Town has owned and operated its own
quarry located on Morgan Road in the former Township of Clarke.
All materials extracted from this site were charged to various projects

within the Town at cost. Cost in this instance means, expenses incurred
to stock pile stone, haul to contractor for crushing, crushing charges,
and transportation costs for delivery direct to the project site or

works yard for stock piling. The approximate cost of this operation is $1.00
per cu. yd. of material extracted.

If the Town did not own its own Quarry, then we would have to obtain
this material from local supplies at a cost of approximately $1.50 per cu. yd.

COMMENTS:
Staff believe that we should charge ourselves the local market price of $1.50
per cu. yd. and any surplus realized from annual quarry operations be transferred
to a Pit & Quarry Reserve Account at Year-End. Prices are subject to change
depending on market conditions. . . . . ./2

The logic in establishing such a reserve would be to provide for:
1 . Paying of any claims which could result from the use of the site,
such as de-watering of wells, etc.
2. Rehabilitation of the site in accordance with the Pits & Quarries Act,
and as per Ministry of Resources direction.
3. Purchase of another site, upon the depletion of the existing location.
In view of the foregoing, staff recommend that the attached Reserve for
Pits and Quarries be established.

By-Law 82- 145
Being a By-Law to establish a Pits & Quarries
Reserve Account
WHEREAS the Council of the Corporation of the Town of Newcastle considers
it desirable to establish a Pits & Quarries Reserve.
AND WHEREAS, Chapter 302, Section 165 of The Municipal Act, R.S.O. 1980 as
stated herein as follows:
"Every municipality as defined in the Municipal Affairs Act and
every board, commission, body or local authority established or
exercising any power or authority with respect to municipal affairs
under any general or special Act in an unorganized township or in
in unsurveyed territory may in each year provided in the estimates
for the establishment or maintenance of a reserve fund for any
purpose for which it has authority to spend funds, provided that,
where the approval of the council is required by law for a capital
expenditure or the issue of debentures of or on behalf of a local
board, the approval of the council of a provision in the estimates
of the local board for a reserve fund shall be obtained. 1976,c.69,
s.7(1 ).
NOW THEREFORE, be it ENACTED and it is ENACTED as a By-Law of the Corporation
of the Town of Newcastle as follows:
1 . That the Treasurer is authorized to establish a reserve account
entitled Pits and Quarries Reserve.
2. That the net proceeds derived from annual quarry operations be
credited to this Pits and Quarries Reserve.
3. That the Council may by resolution passed by a majority of members
present, direct the use of the funds for specific projects relating
to the paying claims related to the operation of the pit/quarries, the
purchase of another site and/or to refurbish/rehabilitate the existing
site.
4. That Council may by By-Law direct the use of the funds for any other
purpose for which it has the authority to spend monies.
