This report be received; and 2. The attached by-law establishing the Clarke Museum and Archives Development Reserve Fund be approved and forwarded to Council ; and 3. The Clarke Museum and Archives, P.O. Box 121, Orono, Ontario, be informed of the actions of the Committee and Council . BACKGROUND AND COMMENT: Subsequent to a request by the Clarke Museum and Archives Board (letter attached) and other communications (attached) we bring this matter to Committee's attention as the establishment of reserve funds require the approval of Council . The attached correspondence gives the reasoning for the establishment of the reserve fund, in the opinion of the Board, and we have incorporated these terms in the by-law. Staff can see no reason why these funds cannot be set aside .in a reserve fund as requested by the Board. WHEREAS, the Council of the Corporation of the Town of Newcastle considers it desirable to establish a reserve fund for the purpose of providing funds for the Development Fund of the Clarke Museum and Archives Development, AND WHEREAS, Chapter 302, Section 165(1) of the Municipal Act RSO 1980 provides, that , "Every municipality as defined in the Municipal Affairs Act and every board, commission, body or local authority established or exercising any power or authority with respect to municipal affairs under any general or special Act in an unorganized township or in unsurveyed territory may in each year provide in the estimates for the establishment or maintenance of a reserve fund for any purpose for which is has authority to spend funds, provided that, where the approval of the council is required by law for a capital expenditure or the issue of debentures of or on the behalf of a local board, the approval of the council of a provision in the estimates of the local board for a reserve fund shall be obtained. 1976,c.69,s.7(1). NOW THEREFORE, BE IT ENACTED and it is ENACTED as a By-Law of the Corporation of the Town of Newcastle as follows: 1 . That the Treasurer be authorized to establish a reserve fund entitled "Clarke Museum and Archives Development Reserve Fund," 2. That such funds as are held in Saving Account # 9503269 of the Orono CIB.0 .- .Bank on the date of passing of this By-Law be transferred to the Clarke Museum and Archives Development Reserve Funds. 3. That the additions to this fund be from the proceeds of various fund raising projects such as auction sales, local canvasses, bequests, etc. 4. That the uses of this fund be for the development of the Museum and Archives collections and facilities. 5. That Council may by a resolution passed by a majority of the members present direct the use of funds for specific projects relating to the Clarke Museum and Archives. 6. That Council may by By-Law direct the use of the funds for any other purpose for which it has authority to spend monies. These monies have been accumulated since 1977 from the proceeds of fund raising projects, a booth to sell articles at the Orono Fair and an Auction Sale and other projects. While this account has been designated "Development Fund1t It has been included in the yearly operating funds of the Museum. It is the wish of the Committee that this account be separated from the current operating account. Provincial Government regulations indicate that a Museum may have a Development Fund. It is the Committee's understanding that the requested designation will n�. ed to be approved by Council. Box 121 ORONO, Ontario LOB IMO Dear Mr. Dickson: I am in receipt of your letter dated August 2, 1982 regarding the Museum Board's request to designate certain funds as a "Development Fund." I will be happy to forward this request to Committee with a recommendation for approval but require further information before the report can be drafted. The information required includes: (i) The exact reference used from the regulations as they relate to museums which allows for the establishment of such a fund; and (ii ) The sources of funds for additions to this fund in the future; and (iii ) The uses of the funds in the future. These items can all then be incorporated into a bylaw or resolution establishing the fund and it perameters. If you can have a reply back to me prior to September 1 , 1982 I may be able to include this report on the first Committee meeting in September. I look forward to your reply. Yours truly, K. KC/hl Treasurer Orono, Ontario August 25, 1982 The Treasurer, Corporation of the Town of Newcastle, Bowmanville, Ontario Dear Mrs Campbell: Re: Clarke Museum and Archives Referring to your letter dated August 10, 1982 relative to the above, the information regaested is recorded below: (i) By-Law No 74-40 Section 15 Page 3 authorizes the Museum Board, with the approval of Council, to establish a Museum Development Fund, into which donations and net revenues may be placed for future Museum developmehts. (ii) It is the intention of the Museum Committee to actively pursue the raising of funds for future development of the Museum. Sources of such funds will be by - Auction Sales, donations, local. canvasses, Wintario and other fund raising projetc, etc. etc. (iii) Funds are to be used for further development of the Museum and for the provision of new and/or improvement to present facilities. The Committee is at present unable to make definite plans regarding the above, due to the lack of a feasibility study of the buildings in the area proposed by Council some time ago but as yet not available.
