SUBJECT: Terms of Reference - Department Heads
As part of the review of the by-laws of the Town of Newcastle it was noted
that by-laws had been prepared setting out the terms of reference for the
following positions: Treasurer, Director of Planning, Town Manager and By-
Law Enforcement Officer, but did not include the following positions: Clerk,
Fire Chief, Director of Public Works and Director of Community Services.
To correct this omission we propose to prepare by-laws to cover terms of
reference for the Fire Chief and Director of Public Works for the first
Council meeting in February and the by-laws for the Clerk and Director
of Community Services are submitted with this report for your consideration.
THE CORPORATION OF THE
TOWN OF NEWCASTLE
BY-LAW NO.
BEING A BY-LAW TO DEFINE THE DUTIES AND
RESPONSIBLITIES OF THE TOWN CLERK.
WHEREAS a Council of a Municipality is required by Section 215 of the Municipal
Act, Chapter 284, R.S.O. 1970 as amended to appoint a Clerk.
AND WHEREAS the Council deems it necessary to define and determine the duties
and responsibilities of the Town Clerk by By-Law.
NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts
as follows:
1) The duties of the Clerk of the Town of Newcastle shall be all of those
duties imposed by statutes of the Province of Ontario and by-laws of the
Corporation which shall include but not be limited to the following:
1. Provision of secretarial services to the Council, including the
preparation of its meeting agendas, recording of its minutes and
the processing of correspondence from its meetings.
2. The processing and distribution of all correspondence not requiring
the consideration of the Council.
3. Preparation of by-laws,resolutions and agreements with the assistance
where required, of the Town Manager and Town Solicitor.
4. Custody of minutes of Council and its Committees, by-laws and
other records and documents.
5. Returning Officer for all municipal elections and votes on by-laws
or questions and all duties imposed on the Returning Officer, Revising
Officer and Clerk by the Municipal Elections Act and other Acts
of the Legislature relating to votes.
6. Issuer of Marriage Licenses and Division Registrar of Vital Statistics.
7. Municipal Licensing
S. Arrangements for all Public Meetings and Official Town Functions.
9. Administrative procedures relating to assessment cancellation of taxes
and supplementary taxation as prescribed by the Assessment Act and
Municipal Act.
10. Information to Council upon duties, obligations and authority for its
procedure.
11. All procedures under the Planning Act.

12. To perform such other duties and exercise such other powers that
may from time to time be lawfully assigned to or vested in him/her by
Council.
2) That all by-laws passed by the former Town of Bowmanville, Village of Newcastle
Township of Clarke and Township of Darlington setting out the duties and
responsibilities of the Clerk are hereby repealed.

BY-LAW
BEING A BY-LAW TO DEFINE THE DUTIES AND
RESPONSIBILITIES OF THE DIRECTOR OF COMMUNITY
SERVICES.
WHEREAS the Council has appointed a Director of Corrnnunity Services.
AND WHEREAS Council deems it advisable to define the duties and responsibilities
of the Director of Community Services.
NOW THEREFORE, the Council of the Corporation of the Town of Newcastle
enacts as follows:
1. That the Duties of the Director of Community Services shall include
but not be limited to the following:
1) Head of the Department of Community Services and responsible
for the administration of the following functions within the
policies established by the Community Services Committee and
approved by Council of the Corporation of the Town of Newcastle.
(a) Recreation Programs
(b) Darlington Arena and Bowmanville Arena
(c) Swimming Pools
(d) Parks
(e) Cemeteries
2) Personnel employed in the functions and facilities outlined in sub-
paragraph one above shall be under the direction of the Director of
Community Services who shall be responsible for the utilization of
such personnel to carry out approved policies and programs.
3) Preparation of the annual budgets for the above functions and facilities
and control of expenditures therein.
4) To account to the Treasurer of the Corporation for all revenues accruing
to the Department of Community Services.
5) To ensure the enforcement of such regulations as may be adopted for the
operation of the respective functions and facilities.
6) To perform such other duties that may from time to time as may be
assigned by Council.
2. That all by-laws passed by the former Town of Bowmanville,Village of Newcastle
Township of Clarke and Township of Darlington setting out the duties and
responsibilities of the Director of Recreation are hereby repealed.

being, a by-law to appoint a Chief Building
Official and Building Inspectors pursuant to
the Ruil0ing Code Act 1'%74
THE COUNCIL OF THE TOWN OF NE3CASTLE ENACTS AS FOLLOWS :--
1. The person shown on Schedule "A" to this by-law is hereby appointed
as Chief Building Official for the Town of Newcastle.
2. The persons listed on Schedule "B" to this by-law are hereby
appointed Inspectors for the Town of Newcastle to perform duties
under the Ontario Building Code Act and Regulations thereunder.
3. The person shown on Schedule "C" to this by-law is appointed an
inspector for the purpose of reviewing plans and performing.
inspections related to fire access routes, fire alarms , fire
detection and supression systems and such further related
installations , equipment or systems as may be required under the
Building Code Act 11:74 and the Regulations thereto.
4. The Clerk of the Town of Newcastle shall issue a certificate of
appointment bearing his signature or facsimile thereof to the
Chief Building Official and to each Inspector appointed by the
Town Council .

BY-LAW NO. 77-21
! being a by-law of the Corporation of the Town of
t Newcastle to appoint a Treasurer.
WHEREAS pursuant to Q e provisions of Section 218 of The Municipal Act,
R.S.O. 1970, the Council of every municipality shall appoint a Treasurer,
NOW THEREFORE the Corporation K the Town of Newcastle by its Council
ENACTS AS FOLLOWS:
1. THAT Klaas DeCroot he and he is hereby appointed Treasurer of the Town.
as of April 25th., 1977.
2. The said K.laas DeGroot shall perform all statutory duties of a
Treasurer including the following
(a) He shall be the head of the Treasury Department and adviser
to Council on all matters pertaining to the finances of the
municipality.
(b) He shall carry out all duties imposed upon him as Treasurer
by the Statutes of Ontario, a familiarity with which he
acknowledges by the acceptance of the office of Treasurer.
(c) As head of the Treasury Dupartment he ,hall be responsible for
its organization and administration, including the deployment
and training of Department staff, subject to Council's approval
of staff complement and remuneration.
(d) He shall be responsible for the installation and operation of
a system of accounting which is in accordance with accepted
principles of municipal accounting and in keeping with the
standard classifications, where applicable, of the Ministry
of Treasury, Economics and Tntergove.rnmental Affairs of the
Province of Ontario.
(e) He shall set up and maintain, or cause to he maintained, a set
of books faithfully and accurately setting forth, from day
to day, a record of all moneys received by or disbursed on
behalf of the Corporation and maintain an accurate record of all
other accounting and financial transactions of the Corporation.
(f) He shall be responsible for keeping account, at all times, of
cash, investments, receivables, inventories, equipment and
buildings and ,shall endeavour to account for and ensure payment
at the proper time of all current., long term and debenture
liabilities of the Corporation.
(g) He shall administer and co-ordinate the preparation annually

of the estimates For the financial operation of the municipality
and shrill bu responsible for their submission to Council in
accordance with the procedural and other requirements of Council .
(h) Ac shall be diligent in ansur.iug the prompt collection of all
rates and taxes; on all rolls returned to him and all interest,
penalties, rentals, license fees and other moneys due to the
Corporation instituting, wh%re necessary, such Proceedings as
may be required for their recovery.
(i) He shall be custodian of all debentures and securities of the
Corporation and shall keep all such debentures and securities
in locked safety deposit boxes in a security deposit vault and
only such officials as shall he designated by Council shall have
access to such boxes.
(j) He shall set up and keep, or cause to be kept., the proper
necessary books and registers for the purpose of recording the
Debenture Debt of the Corporation and all changes therein, and the
retirement and redemption of the maturing issues, both as regards
principal and interest or of any other nature whatsoever. Such
books and registers shall also set forth the provisions to be made
with the Bankers and Agents of the Corporation, both in Canada
and elsewhere, for the meeting of all principal and interest
as these become due.
(k) He shall present to Council annually a statement of the assets,
liabilities., revenues and expenditures of the Corporation and
if required by Council shall present a monthly statement contain-
ing similar information and he may also present. a Special report
which, in his opinion as Treasurer should
be presented for the information of Council.
(1) He shall., subject to the approval of Council, see that monies
to the credit of any trust, reserve or general fund of the
Corporation that are subject to or available for investment are
invested in propnrly authorized securities according to the
by--laws or practices governing the particular fund. It shall
be his responsibility to recommend to Council the type of
investments than he believes to be the most acceptable for the
purposes of the particular fund.
(m) He shall be responsible for the maintenance of suitable and other
insurance coverage on all property belonging to the Corporation,
(n) He shall establish a Petty Cash Fund and such procedures as are
necessary for the administration an3 control of the Fund and

make recommendations to Council to allocate Petty Cash Funds to
departments of the Municipality in such remounts as he deems
necessary to meet the requirements of .such departments,
(o) He shall be the custodian of all bonds and securities of fidelity
given for the faithful discharge of the duties of the officials
and servants of the iunicipality, excepu his own, which shall be
deposited with the Clerk 6f the Municipality.
(p) He shall have this right to demand of any officer or servant of
the Municipality any information which may be necessary for the
carrying out of his duties as Treasurer.
(q) He shall attend the meetings of Council and of its Committees
as required by Council.
(r) He shall,, before entering on his duties, make and subscribe a
declaration of office and give such security as Council directs
for the faithful performance of his duties.
(s) He shall bn governed by such other by-.laws as affect the duties
of his office and perform such otter duties as may he lawfully

3. By-law No. 74 .4 is herehy repealed.
