Newcastle Village Arena
"THAT the Council of the Town of Newcastle instruct
the Town Manager to prepare an agreement with CIMCO for the
Mayor and Clerk's signatures to replace the Village of
Newcastle Arena concrete surface that is now deficient with
a new concrete surface and associated refrigeration piping
as specified in CIMCO's proposal of August 30th, 1979
in the amount of $65,200.00. The funding for this amount
to be provided by the Newcastle Arena Committee in the
amounts required, considering the Province of Ontario funding
that is currently under consideration.
In keeping with the Town of Newcastle's wishes the Town
will front end the capital costs from the Industrial
Development sinking fund and the interest charges will be
assumed by the Newcastle Fund Raising Committee. The
consultants fee will be paid by the Town of Newcastle as
previously done.
AMENDED "THAT the following words be deleted from the foregoing
resolution "and the interest charges will be assumed by
the Newcastle Fund Raising Committee."
As instructed by resolution #C-1133-79 we have prepared the attached stipulated
price contract with CIMCO Limited for the removal and reinstallation of the
ice pad (artificial in surface) and all associated work at the Newcastle Arena.
You will note on page 2-2 Article A-2 Contract Documents that we have specifically
included as part of the contract the Quotation Form dated August 30th, 1979 from
CIMCO Limited and we have further clarified the additions and deletions in this
section.
The Treasurer reviewed the contract and requested that this contract be modified
by amending clause 23-2 which provides only five days for payment of payment
certificates to fifteen days for payment of payment of certificates. This change
has been made and noted on page 2-2 of the contract.
The documents were then taken to Totten, Sims, Hubicki and their comments are
noted on their letter dated September 6th, 1979 a copy of which is attached.
We then forwarded the contract to the Town Solicitor requesting he review same.
Mr. Sims in his letter dated September 6th, 1979 states he finds the contract
in order and it is satisfactory for execution by the Mayor and Clerk.

Staff have prepared the contracts and drafted the necessary by-law to
authorize the executive of the contracts if this is the wish of Council.
