SUBJECT: Interpretation Bill 123
"An act to provide for Municipal Hydro-Electric
Service in the Regional Municipality of Durham
Section 2, Sub-Section 18."
As requested I contacted Mr. A. Frame assistant to the Minister of Energy
regarding the above section and explained the interpretation which was
put forth at the Council Meeting on August 27th, 1979.
"The interpretation put forth at that time was that Sub-Section
18, of Section 2 only applied to first Commissions of Pickering
and Whitby and did not apply to the first Commission of Newcastle."
Mr. Frame advises that sub-section 18 of Section 2 applies to all Commissions
formed by Bill 123 and the sub-section specifically refers back to Section
2, sub-section 1 which states as follows:
2(1) "On the day this act comes into force, a hydro electric
commission for each area municipality is hereby established."
Mr. Frame also drew to my attention that it was the policy of his Ministry
not to give legal interpretation of statutes, and if Council wished to get
a legal opinion then it should be sought from the Town Solicitor.
