SUBJECT: Memorandums of Settlement with the Canadian Union
of Public Employees and its Local 74
As instructed by Council your Negotiation Committee has held a series of
meetings with Union representatives and during conciliation before a
Provincial Conciliation Officer the attached Memorandums of Settlement
were reached and agreed that they be recommended to our respective principals
for approval.
The agreements were reached in accordance with the directions given to z
the Negotiation Committee on April 26th, 1979 with the following exceptions: 0
1.) That the following benefits be implemented on September lst, ,?
1979 instead of January lst, 1980.
(a) Dental Plan 50/50 on September 1st, 1979 and 75/25 on July N,
lst, 1980. "
(b) Vision Care to be added to existing Medical Plan on September
lst, 1979 instead of January lst, 1980.
- add prescription glasses maximum $60.00 every two years.
2. ) Wages were settled on an across the board basis instead of a weighted
average basis as discussed previously. The Union could not agree on
a weighted average basis.
3.) The third item that differed from our last discussion was the splitting
of Labour Classification in the Outside Union. The purp6se of this division
was to recognize the Animal Control Officer II and Maintenance and Parks
and Cemetery Personnel are required to operate vehicles and motor
equipment which is not included in the labour classification.
The exceptions as outlined above will cost an additional $2,860.00 for 1979 as
follows:

Recommendation: That Council approve the Memorandums of Settlement with the
Canadian Union of Public Employees and its Local 74 and that the Mayor and
Clerk be authorized to execute an amended agreement with the Union which will
incorporate the changes as specified in the Memorandums of Settlement.

MEMOKANDUM OF SETTLEMENT
BETWEEN: The Municipal Corporation of the Town. of Newcastle
AND: The Canadian Union of Public Employees and its Local
74 (Inside Workers)
The parties to this memorandum of agreement agree to unanimously recommend
to their respective principals the following as full settlement of all
issues in dispute.
(1) The Collective Agreement bearing the expiry date of December 31st, 1978
shall be renewed with the following changes:
Article 8 Amended to read the same as amended outside agreement.
Article 14:01 (d) Amend to read same as amended outside agreement.
Article 15:01 Courtesy job posting as in outside agreement as
amended.
Article 15:02 Delete
Article 16:01 delete "supervisory positions" and insert"positions
outside this agreement."
Article 17:03 same as outside agreement
Article 18: 01 wording same as amended outsid
Article 18:03 wording same as amended outside
Article 19:02 Five days notice as per outside agreement
Article 20:00 Hours of Work
35 hours per week for all employees except Parking
Enforcement effective the Monday following
ratification of the Collective Agreement.
Hours to be 8: 30 a.m. to 4:30 p.m.
Article 20:01 Delete
Article 21:04 24C per mile 1979

MEMORANDUM OF SETTLEMENT
BETWEEN: The Municipal Corporation of the Town of Newcastle
AND: The Canadian Union of Public Employees and its Local
74 (Outside Workers)
The parties to this memorandum agree to unanimously recommend to their
respective principals the following as full settlement of all issues in
dispute:
(1) The Collective agreement bearing the expiry date of February 28th, 1979
shall be renewed with the following changes:
Article 8:01 Step #1 Change Divisional Superintendent to read
Supervisor.
Step #2 Change Director of Public Works to read
Department Head.
Step #3 Change steward to grievance committee
Article 8:01 preamble delete permanent.
Article 14:01 (d) add the Corporation may extend the five day period
under extenuating circumstances.
Article 15:01 acid courtesy job postings and add "The employer
agrees that there will be no outside advertising
until the job posting processes has been completed
Article 15:02 delete
Article 16:01 delete supervisory position and insert positions outside
the agreement.
Article 17:03 The union shall be notified of the successful applicant
within fifteen days of the filling of the position.
Article 18:01 Benefits paid for leaves up to 30 days thereafter paid
in advance by employee.
Article 18:03 Change to read conventions, meetings, seminars, schools.
Article 19:02 Unless legislation is more favourable to the employees,
the employer shall notify employees who are to be laid
off five (5) days prior to the effective date of the lay
off. If the employee has not had the opportunity to work
the days as provided in this Article he shall be paid for
days for which work was not available.
Article 21:04 amend last sentence to read without permission of the
Department Head.
Article 21.05 amend to read protective clothing will be supplied to

Article 21:07 amend to read $35.00 1.979 and $40.00 1980.
Article 23:02 add following to existing, "such payment shall be
charged against his sick leave credits to limit
of such accrued credits.
Article 24:01 (c) add prescription glasses maximum $60.00 every two
years effective September 1st, 1979.
(d) new dental plan equivalent to Blue Cross #9 -- 1979
O.D.A. fee schedule effective September lst, 1979
employer to pay 50% - effective July 1st, 1980
employer to pay 75%.

Article 25:05 amend last Sentence to read"the vacation shall be
approved by the appropriate Department Head.

Article 26:04 amend to provide double time for holidays effective
January 1st, 1980.
Article 28:01 amend to read March lst, 1979 and add January lst, 1980.
Article 30:01 agreement expires December 31st, 1980
