Guiler, Town Manager DATE: February 19th, 1979 SUBJECT: Appointment of a Solicitor for Ontario Municipal Board Hearings Re: Courtice's residential designation in the Durham Official Plan, The Townline Centre Designation in the Oshawa Official Plan and the Anticipated Referral of the Courtice District Plan. As instructed we contacted Mr. Ron Webb of the firm of Davis, Webb and Hollinrake and Mr. David Greenspan regarding the above hearings. WEBB Mr. Webb stated that he would be available, but only if we took immediate steps to apply for an adjournment as he would be unavailable on March 17th, 1979. He stated he has had experience on numerous hearings regarding Residential, Commercial and Industrial Developments but has no experience in Shopping Centre Hearings. Mr. Webb stated that he may have a possible conflict of interest as he represents a Developer in the north part of Courtice (Chalbey)see O.M.B. Feb R-781162. This matter was discussed with Mr. Kristof and it is his considered opinion that there is a definite conflict of interest. At any rate we asked Mr. Webb his hourly rate and his quote is as follows: Hourly Rate $80.00 Daily Rate $800.00 Mr. Webb estimated that this hearing would take approximately 15 days at an estimated $12,000.00. This estimate does not cover the costs of expert witness that may be required to substantiate the Town's position at these hearings. GREENSPAN In reference to Mr. Greenspan's qualifications and fees see attached letter from Mr. Greenspan dated February 14th, 1979. From the information provided by both Solicitors and in view of the fact that our Planning Director states that Mr. Webb has a conflict of interest in regards to the Courtice Envelope,we would respectfully recommend to Committee that David Greenspan be retained to represent the Town at these hearings or if this is not satisfactory to Committee that we look for another solicitor.
