REPORT NO.: P-100-81 SUBJECT: By-law 1968 - Township of Hope RECOMMENDATION: It is respectfully recommended that: 1. By-law 1968 of the Township of Hope be received and filed. BACKGROUND: By-law 1968 of the Township of Hope was forwarded to the Planning and Development Department May 13, 1981. The By-law rezones a parcel of land in the former Township of Hope from General Agricultural Zone (A2) to the Rural Residential Exception Zone Four (RR4) in order to permit the erection of one (1) single-family dwelling. COMMENT: The subject parcel is in Lot 34, Concession 9 of the former Township of Hope and does not affect the interests of the Town of Newcastle. April.. 1981. . . . THE CORPORATION OF THE TOWNSHIP OF HOPE BY-LAW NO. 1968 BEING A BY-LAW TO AMEND RESTRICTED AREA BY-LAW NO. 1518 AS OTHERWISE AMENDED, OF THE CORPORATION OF THE TOWNSHIP OF HOPE. WHEREAS the Council of the Corporation of the Township of Hope has received a request to amend Restricted Area By-law No . 1518, as otherwise amended, being the comprehensive Zoning By-law of the Corporation, with respect to part of Lot 34, Concession 9, in order to fulfill one of the conditions established by the Committee of Adjustment of the Township of Hope for the creation of a lot on the subject lands; AND WHEREAS the Council of the Corporation of the Township of Hope has given this request serious consideration and deems it advisable to amend Restricted Area By-law No. 1518, as otherwise amended, with respect to those lands comprising part of Lot 34, Concession 9. NOW THEREFORE the Council of the Township of Hope ENACTS as follows : 1. THAT Schedule "C", Map 2, the Zone Map forming part of Restricted Area By-law No. 1518, as otherwise amended, is hereby amended by changing the Zone Classification on those lands comprising part of Lot 34, Concession 9, in the Township of Hope, from the General Agricultural Zone (A2) to the Rural Residential Exception Four Zone (RR-4) in accordance with Schedule "A" , Zone Map, attached hereto and by this reference forming a part thereof. 2. THAT Section 10, Rural Residential Zone (RR) , of Restricted Area By-law No. 1518, as otherwise amended, is hereby amended by adding to the end of Subsection 3 thereof, entitled "SPECIAL PROVISIONS" , the following clause (d) : "(d) RR-4 ZONE, PART LOT 34, CONCESSION 9 Notwithstanding the minimum lot area and lot frontage requirements of Restricted Area By-law No. 1518, as otherwise amended, for the Rural Residential Zone (RR) , within the Rural Residential Exception Four Zone (RR-4) , located in part of Lot 34, Concession 9, the minimum lot area requirement shall be 2 hectares and the minimum lot frontage requirement shall be 88 metres. " -2- BY-LAW NO. 1968 3. THAT this By-law shall become effective on the date of passing hereof by the Council of the Corporation of the Township of Hope, subject to notice hereof being circulated in accordance with the provisions of Section 35 (24) of The Planning Act, R.S.O. , 1970, c. 349, as amended, and, if required as a result of such circulation the cbtaining of approval of the Ontario Municipal Board. SCALE IN METRES 60 0 60 120 ppj 240 300 , . � t 1l SCHEDULE 2 (i) Restricted Area By-law No. . . 1968,, , ,, has the following purpose and effect: i. to rezone a parcel of land having an area of approximately 2 hectares (5 acr s) comprising part of Lot 34, Concession 9, from the General Agricultural Zone (A2) to the Rural Residential Exception Four Zone (RR-4) in accordance with Schedule "A' attached to and forming part of Restricted Area By-law No. 1968 , The general location of the subject lands is shown on Schedule 2 (ii) , Key PI p attached hereto. ii. to fulfill one of the conditions established by the Committee of Adjustment of the Township of Hope for the creation of a lot. Within the RR-4 Zone, a lot having a minimum area of approximately 2 hectares (5 acres) will be created. iii.to establish a minimum area requirement of 2 hectares (5 acres) and a minimum lot frontage requirement of 88 metres (288 feet) within the RR-4 Zone. Under the provisions of Restricted Area By-law No. 1518, as otherwise amended, the minimum lot area requirement for the Rural Residential Zone (RR) is 0.4 hecta es m (1 acre) and the minimum lot frontage requirement is 45 metres (150 feet). This enhancement of the RR Zone provisions will prohibit the further severing of lands within the RR-4 Zone. iv. to permit the erection of one (1) single-family dwelling house within the area placed within the RR-4 Zone.
