SUBJECT: By-law 32-81 -- City of Oshawa
RECOMMENDATION:
It is respectfully recommended that:
_ 1. By-law 32-81 of the City of Oshawa be received and filed.
BACKGROUND-
By-law 32-81 of the City of Oshawa was forwarded to the Planning
and Development Department May 13, 1981. The By-law rezones a parcel of
land, fronting on Skae Drive, in the City of Oshawa, from Special Condition
91 to Special Condition 104 in order to permit a contractor's yard for the
repair, maintenance and outside storage of refuse collection containers and
vehicles together with an accessory office.
COMMENT:
The subject parcel is located in the City of Oshawa and does not
affect the interests of the Town of Newcastle. Accordingly, no action on
the rezoning by-law is required. The date for filing objections is June 2, 981.

NOTICE OF APPLICATION TO THE ONTARIO MUNICIPAL BOARD BY THE
CORPORATION OF THE CITY OF OSHAWA FOR APPROVAL OF A BY-LAW -T0
REGULATE LAND USE PASSED PURSUANT TO SECTION 35 OF THE.FJ,ANNING
ACT
TAKE NOTICE that the Council of The Corporation of the City of Oshawa intends to
apply to The Ontario M:#acipal Board pursuant to the provisions of Section 35 of
The Planning Act for approval of By-law Number 32-,81 passed on the 21st day of
April 1981. A copy of the by-law is furnished herewith. A note giving an
explanation of the purpose and effect of the by-law and stating the lands affected
thereby is also furnished herewith.
ANY PERSON INTERESTED ,MAY within twenty-one (21) days after the date of this
notice, send by registered mail or deliver to the Clerk of the City of Oshawa
notice of objection to 'approval of the said by-law or part thereof giving details
of all or the portion of the by-law to which you object and detailed reasons
therefor, and shall indicate that if a hearing is held the objector or an agent
will attend at the hear. g to support the objection.
ANY PERSON wishing to support the application for approval of the by-law may
within twenty-one (21) days after the date of this notice send by registered mail
or deliver to the Clerk of the City of Oshawa notice of his support of approval of
the said by-law together with a request for notice of any hearing that may be held
giving the name and address to which such notice should be given.
THE ONTARIO MUNICIPAL BOARD may approve of the said by-law but before doing so it
may appoint a time and place when any objection to the by-law will be considered.
Notice of any hearing that may be held will be given only to persons who have
filed an objection or notice of support and who have left with or delivered to the
Clerk undersigned, the address to which notice of hearing is to be sent and
similarly, to any person who has filed a request for a change in the provisions of
the by-law.

BE IT ENACTED AND IT IS HEREBY ENACTED as a by-la
of The Corporation of the City of Oshawa by the Council thereof as
follows:

1 • That! By-law Number 3415 as amended is hereby further
amended by amending Schedule "A" thereof by adding thereto Special
Condi=tion "1041" as set out in Schedule "B" atached to this by-la .

Sheet Number 12 of Appendix "A" to By-law Number 3415, as

amended, is hereby further amended by changing the land use
designation for a parcel of land on the east side of Skae Drive,
north of Terwi.Jlegar Avenue, having a frontage o

metres on SkaeiDrive and a depth of approximately 88 metres shown
hatched and marked with the number "104" encircled on the revised
Sheet Number 12 attached hereto as Schedule "A" from IP subject t

that the said Sheet Number 12 shall be amended as shown on the
revised Sheet Number 12 attached to this by-law as Schedule "A" .

SPECIAL CONDITION 104
A parcel of land comprising not less than 0 .473 hecta res
located on the east side of Skae Drive, north of Terwillegar
Avenue, as shown on Schedule ""A" and marked with the number "104"
encircled shall be subject to the special regulations hereinafter
contained and where there is a conflict between the regulations
hereinafter set out and any other provisions of this by-law, th se
special regulations shall apply, but in the event that this Special
Condition is silent on any matter then the provisions applicable to
an IP use district only and By-law 55-73 shall apply.
1 .1 DEFINED AREA:
The area subject to this Special Condition is as show
on Schedule "A" hereto, outlined in heavy line and
hatched with the figure "104" encircled.
1 .2 FRONTAGE:
The minimum FRONTAGE of any LOT shall be 45 metres .
1 .3 LOT AREA:
The minimum LOT AREA shall be 0. 4 hectacres .
1.4 YARD DEPTH:
The minimum YARD depth shall be 9 .0 metres .
The minimum SIDE YARD depth shall be 4. 5 metres .

1.5 PERMITTED USES:
1 . 2. 1 . All uses permitted in an IP use district.

and outside storage of refuse collection
containers and vehicles and accessory uses
thereto.
1.6 OFF-STREET PARKING AND LOADING :
Off-street parking and loading facilities shall be
provided in accordance with By-law 55-73 .
EXPLANATORY NOTE.
EXPLANATION OF THE PURPOSE AND EFFECT OF BY-LAW NUMBER 32-81
By-law Number 32-81 changes the land use designation for a parcel
of land on the east side of Skae Drive, north of Terwillegar
Avenue, having a frontage of approximately 53 metres on Skae Drive
and a depth of approximately 88 metres from IP subject to Special
Condition 91 to IP subject to Special Condition 104 to permit in
addition to the uses permitted in an IP use district, a
contractor' s yard for the repair, maintenance and outside storage
of refuse collection containers and vehicles together with
accessory office uses on lands having a minimum frontage of 45
metres and having a minimum lot area of 0 .4 hectares and permits a
minimum yard depth of 9 .0 metres and a mimimum side yard depth of
4. 5 metres.
