REPORT NO. : P-84-81 SUBJECT: Proposed Site Plan Agreement - Part of Lot 29, Concession 1, former Township of Darlington Bowman Construction Ltd. - File: S-P-1-9 RECOMMENDATIONS: It is respectfully recommended that the Planning and Development Committee recommend to Council the following: 1. That Report P-84-81 be received; and 2. That the attached Agreement be executed; and 3. That the Clerk be directed to prepare a by-law for the purposes of authorizing the execution of the attached development agreement for submission to and consideration by Council at its meeting of May 19, 1981. BACKGROUND: On March 4, 1981, staff received the subject application , for site plan approval. The subject site is located within the Marnie Industrial subdivision on Cigas Road and is comprised of - 2 - Parts 6 and 7 of Reference Plan 1OR-1229. The applicant is pro- posing the construction of an industrial building totalling 1950 square metres, consisting of a total of twelve separate units to be constructed in three progressive stages of four units each. COMMENTS: In accordance with the Department's procedures, this appli- cation was circulated to affected agencies and departments for com- ments. A review of the comments received identified concerns in respect of lot drainage, access for emergency vehicles and adequacy of the private waste disposal system. These matters have been addressed by the terms of the attached draft Development Agreement as follows; grading and drainage plans must be approved by the Director of Public Works prior to the issuance of building permits; access to the building has been improved and driveways and access lanes must be maintained free of parked vehicles as fire access routes; and the issuance of building permits for phases 2 and 3 will be contingent upon the applicant receiving all necessary Health Unit approvals. Owing to the nature of the application, it was not considered necessary to convene a meeting of the Town's Site Plan Committee. The draft Agreement and revised site plans, prepared by staff, were discussed with the applicant and all necessary revisions or changes agreed to. In that regard, the applicant has signed back the Agreement and it would now be appropriate to forward the attached Agreement to Council for execution. Respectfully submitted, TTE:lb D. N.
