SUBJECT: Restricted Area By-law 81-15 -- Ridge Pine Park
Incorporated - Objection filed by the Regional
Municipality of Durham - Our File: Z-A-1-7-5(2)
RECOMMENDATION:
It is respectfully recommended:
1. That this Report be received, and the following resol-
ution be forwarded to Council for adoption and submission
to the Ontario Municipal Board;
"WHEREAS the Ontario Municipal Board has considered the
matter of the use of the lands subject to Town of Newcastle
By-law 86-15 and labelled R-60 on Schedule A (Map 5) of the
Durham Regional Official Plan, and
WHEREAS the Municipal Board has decided that the lands labelled
R-60 are designated for use as a mobile home park development
for adults, and
WHEREAS the Ontario Municipal Board's decision was appealed
to the Ontario Cabinet, and

WHEREAS the Ontario Cabinet upheld the Decision of the
Municipal Board, and
WHEREAS the Town of Newcastle has adopted Restricted Area
By-law 81-15 and has entered into an agreement with the
proponents of the Mobile Home Park in respect of the proposed
development, and
in the opinion of the Town in conformity with the Durham
Regional Official Plan.
BE IT NOW RESOLVED THEREFORE THAT:
The Town of Newcastle hereby respectfully requests the
Ontario Municipal Board to approve Restricted Area By-law
81-15 of the Town of Newcastle."
BACKGROUND:
On January 26, 1981, Town Council adopted Restricted Area By-law
81-15 and By-law 81-17 allowing for the execution of a development agree-
ment, in respect of the Ridge Pine Mobile Home Park. In accordance with
required procedures, By-law 81-15 was circulated to all assessed property
owners within 120 metres of the lands. As a result of the circulation,
one objection, from the Regional Municipality of Durham (copy attached) ,
was filed within the 21 day notice period. No other objections were
received.
COMMENT:
In accordance with required procedures, the Town must forward
a comment in respect of the objection to the Ontario Municipal Board.

Staff note that the Regional Objection simply states that
the proposed By-law does not conform to policies of the Durham
Regional Official Plan. Staff, believe the proposed by-law does
conform to the Municipal Board decision in respect of the property,
made as a consequence of the approval of the Regional Official Plan,
and note that the Ontario Municipal Board's decision was upheld by

Resolution contained within the Recommendations.
Staff note that By-law 81-15 requires that each mobile home
must be appropriately serviced and that the development agreement
executed with the Town recognizes that a development agreement in
respect of the provision of Regional Works is required with the Regional
Municipality.
Staff recommend that the matter of the approval of By-law 81-15
be left in the hands of the Ontario Municipal Board as per the recom-
mendation. Staff note that authorization to attend such hearings has
already been granted by Council.

Mr. McIlroy, the Planning Committee of Regional Council
considered the above matter and at a meeting held on
March 5, 1981 Council adopted the following
recommendations of the Committee:
"a) THAT Council advise the Town of Newcastle that the
Regional Municipality of Durham objects to
Restricted Area By-law 81-15 since it does not
conform to policies of the Durham Regional Official
Plan
b) THAT the Regional Solicitor be authorized to make
the necessary representation before the Ontario
Municipal Board and Regional staff be authorized to
appear as witness(es) to support the objection
c) THAT Cna"issioner' s Report No. 81-61 Revised be
forwarded to the Town of Newcastle and Ridge Pine
Park Incorporated.''
