REPORT TO COUNCIL MEETING OF MARCH 23, 1981
REPORT NO. : P-61-81
SUBJECT: Application for Rezoning Z-A-3-7-5, Part Lot -.24,
Concession 6, Clarke - Mr. & Mrs. S. Irwin'
RECOMMENDATION:
It is respectfully recommended:
1. That this Report be received; and
2. That Council consider approving the attached
amendment to By-law 1592.
BACKGROUND:
The above mentioned application was first considered by
the Planning and Development Committee in February of 1980 via Staff
Report P-15-80. At that time, staff recommended that the application
be not approved. Committee, at that time, requested a further Report
from staff which was considered in January of 1981. Staff again re-
commended that the application be not approved. The Planning and
Development Committee considered staff's recommendations and adopted
the following resolution:
"That the Director of Planning contact Mr. & Mrs.
rv3 Irwin and their solicitor to discuss the matter
4f and try to come to some kind of agreement and as-
certain the current situation and report back."

In accordance with the resolution, staff met with Mr. and Mrs.
Irwin and Mr. C. Ewert, their solicitor, to discuss the possibility
of proceeding with a rezoning by-law. It was agreed that staff would
draft a proposed by-law recognizing the existing uses of the property
for the Irwin's consideration. A draft of such a by-law was forwarded
to Mr. and Mrs. Irwin on March 2, 1981 with a request that they provide
At the Planning and Development Committee meeting of March
16, 1981, Mr. C. Ewert appeared before the Committee and indicated that
his clients had no difficulties with the draft by-law and requested
Committee's favourable consideration of the Irwin application. Committee
adopted a resolution on March 16, 1981 to the effect that staff were to
bring forward a further report and draft by-law for consideration at the
Council meeting of March 23, 1981.
COMMENT:
In accordance with the Planning and Development Committee's
direction to staff of March 16, 1981, staff submit the attached zoning
amendment for Council's consideration. The draft by-law reflects the
existing uses of the property while allowing some minor variations in
use in keeping with the current operation on the site. Staff reiterate
the comment above that the by-law appears to be acceptable to the appli-
cants and their solicitor.
