(416)263-2231 REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF MARCH 16, 1981. REPORT NO. : P-51-81 SUBJECT: Maintenance and Occupancy By--law Planning Department File: 8.1.10 BACKGROUND: At the Planning and Development Committee Meeting of March 2, 1.981, staff were requested to bring forward a report on the costs of implementing the Maintenance and Occupancy By-law, approved by Council in June of 1980. History of By-law: On September 5, 1978, A. Guiler presented report TAI-59-78 to the Planning and Development Committee. The report dealt with . the enactment of a maintenance and occupancy standards by-law for the Town of Newcastle, and contained a sample standards by-law. The Committee requested a comment by the Chief Building Official, and on September 14, 1978, a report was submitted by H. Wight. Mr. Wight's comments emphasized the significance of controlling property maintenance, and this view was in part prompted by the large number of complaints from citizens regarding unsafe and unsightly 2 property conditions. Drafting of a by=law for the Town of Newcastle was deferred until June 11, 1979, at which time staff was directed to draft a property standards by-law for the Town of Newcastle. (PD-286-79) The draft Maintenance and Occupancy Standards By-law (copy attached) was circulated to Town Departments for review and comment. On January 22, 1980, the Town Manager submitted the By-law to the Finance and Administration Committee for consideration. The Committee requested staff to convene a meeting with the Durham Feder- atton of Agrtculcure. Accordingly, Town s rr met with representatives of the Federation on two occasions, February 7, 1980 and March 5, 1980. At those meetings a number of the provisions of the draft by-law were discussed and reviewed by those present. The attached Memorandae sum- marize the proposed changes to the draft by-law as agreed to by staff and Federation of Agriculture representatives. On May 13, 1980, staff recommended to the Finance and Admin- istration Committee that the implementation of the by-law be considered by Council in the context of the then. ongoing budget discussions. Finance and Administration Committee adopted the following resolution: #F-121-80 "That it be recommended to Council that they approve of the Maintenance and Occupancy By-law and the amendments in Report P-90-80 and refer it to the Town Manager for advice on administration." A copy of the Town Manager's report, dated May 15, 1980 (TM-15-80) is attached. 3 On June 2, 1980, Town Council passed two resolutions in respect of the Maintenance and Occupancy By-law: .#C-80-773 "That item 6 of the foregoing report be approved." (Note Item six of the Finance and Administration Com- mittee report is Finance Resolution F-121-80) . #C-80-788 "That the Town Manager's report re: Resolution'.4-121-80 dated May 15, 1980 be approved. (TM7-15-80) . (Note: The Town Manager requested that the matter be referred to the t98t Budget.) The cost requirements for the implementation of a property standards program were considered in the preparation of the 1981 budget submission for the Planning and Development Department. As noted in the Submission, reviewed by Planning and Development Committee on February 16, 1981, no provision was made for a property standards officer. In the 1981 through 1983 program, reviewed by staff on February 13, 1981 in conjunction with the 1981 overall budget submission, the future possible staffing of the Department was presented (excerpt from Organizational Chart attached) . (Please note if the future possible staffing of the 'Department is to be discussed, staff suggest that the meeting be held in camera as changes to existing positions are contemplated.) In the future possible staffing, a property standards officer and/ or an additional building inspector is anticipated for 1982. COMMENT: In addition to the cost estimates prepared by A. C. Guiler contained with Town Manager's report TM-15-80, a copy of a Memorandum -4 from Mr. K. DeGroot to D. N. Smith dated September 7, 1979 is attached for Committee's consideration. Staff have also obtained some additional current information from Oshawa and V1iitby as to current salary levels for a property stan- dards officer (attached) . It is estimated that $19,000 would have to be included in the 1981 budget submission in order to start a property standards pro- . grain, calculated as follows: Officer's Salary $ 11,000 & Benefits 1,750 (6 meat hs) Part-time Secretarial 3,000 staff for Officer and Committee Office Supplies 500 Postage Remuneration to Property 2,000 Standards Committee Members Office Furniture 750 $ 19,000 It should be noted that a Property Standards Committee Secretary has not been budgeted for, on the assumption" Lliat those duties could be assumed by existing staff. In view of the recent changes to the Mainstreet Revital- ization Program, discussed in Report P-50-81, Committee may wish to review the implementation of a property standards by-law. Staff note that the by-law has in effect been approved in principle by Town Council, but has not been given .formal reading. RECOMMENDATION: It is respectfully recommended: 1. I find that Section 4 .2, which deals with compliance, does not adequately cover the Municipality's remedies as to recovery of costs incurred, and should, in fact, include a clause that the monies spent as it they were taxes. recovered Section 5.4(3) and 6.6(3) related to placing of plastic garbage bags might put a majority of residents in conflict with the by-law when putting out garbage for collection, however, this may be reasonable to leave in with discretion applied to enforcement. It may be appropriate to attach a proposed cost to this process, and I will, therefore, estimate this as follows: - Perdiem for Board (3 members x 12 meetings @ $50, Secretarial Service $1,800, Enforcement Officer - Salary 8 Benefits 5,000. Other Costs 21,000. Legal Advice 5,000. Annual Costs 5,000. $37,800. To this can be added start-up $3,000. costs for office equipment, etc. , of CURRENT SALARIES/PROPI?RTY STANDARDS OFFICERS 1.
