REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF FEBRUARY

SUBJECT: Correspondence from M. Zygocki regarding the
appraisal of lands for the purposes of calculating
the 5% cash-in-lieu requirement
BACKGROUND:
The attached letter was introduced as a matter of "Other
Business" at the February 2, 1981 Planning and Development Committee
Meeting. The matter of property appraisals in conjunction with sub-
division proposals was briefly discussed. A motion to the effect that
the attached correspondence be referred to staff for a report back to
Committee was adopted.
COMMENT:
In the processing of subdivision plans, the municipality
periodically accepts cash-in-lieu of land in fulfillment of the "5%
parkland dedication requirement". In order to calculate the cash
amount to be received through the execution of a subdivision agreement,
the Town has in the past relied on the Region of Durham Real Estate
Department staff to undertake the necessary property appraisals. On

occasion, Regional staff have, due to other commitments, been unable
to undertake an appraisal, in which case staff have hired independent
appraisers to undertake the work.
Administratively, the developer is asked to provide a letter
of undertaking to the Town to the effect that the cost of the appraisal
will be borne by him. Staff ask the developer to ensure that the letter
indicates that the cost of the appraisal will be paid on the Town's
request or on execution of the subdivision agreement whichever occurs
first.
Staff feel that the current procedure works well and that
the Town has been provided with objective appraisals prepared at rea-
sonable cost. Staff do not feel that it would be appropriate to rely
on a real estate firm to undertake this type of work. For the infor-
mation of the Committee, staff have on, at least, one occasion requested
a second appraisal to be performed on a subdivision plan to satisfy con-
cerns with the original appraisal.
RECOMMENDATION:
It is recommended that:
1. That the Planning and Development Committee receive
this report; and
2. That the Committee endorse the current procedure as
outlined in this report; and
3. Request the Committee Secretary to advise Mr. Zygocki
that the Town will proceed under the current procedure;
and

4. That in accordance with Town procedure, Mr. Zygocki
is requested to forward the letter of undertaking
described in the correspondence of January 2, 1981
between the Town Manager and Mr. Zygocki directly
to the Director of Planning.

a letter of undertaking to pay the cost of a land ap-

Regional Appraisers to prepare the report and forward a
copy to you for your consideration.
