SUBJECT: Proposed Official Plan Amendment
Section 8.1.2.1 - Durham Regional Official Plan

BACKGROUND & COMMENTS:
On December 12, 1980, staff received the attached
correspondence from the Region of Durham. The subject of this corres-
pondence is a proposed amendment to Section 8.1.2.1 of the Durham Regional
Official Plan to permit Personal Service Uses within residential areas.
On July 9, 1980 Regional Council approved Amendment
37 to the Regional Official Plan which permitted limited office develop-
ment and certain retail uses within residential areas subject to inclusion
of appropriate policies within local District Plans and/or restricted
area (zoning) by-laws. That amendment was approved by the Ministry of
Housing on November 17, 1980.
As a result of implementing this policy in respect of
multi-functional areas, the Region indicates that it became apparent
that limited personal service uses would also have been an appropriate
use to be permitted at the discretion of local Council. In that regard,

the subject amendment would, in effect, amend Section 8.1.2.1 (c) ,
which was added by Amendment 37, to include limited personal service
uses.
Inasmuch as this policy supplements Section 7.2.7
of the Durham Plan and remains one of a discretionary nature to be
addressed by the Local District Plan and/or restricted area (zoning)
by-laws, staff have no objection to the proposed amendment.
RECOMMENDATION:
That the Planning and Development Committee recommend
to Council the following:
1. That Report P-26-81 be received; and that
2. The Region of Durham be advised that the Town
of Newcastle has no objection to proposed
Official Plan Amendment 80-55/D.

No. 80-280 approved by the Planning Committee on
December 9, 1980 which includes a proposed Official Plan
Amendment to permit Personal Service Uses within
Residential Areas as defined in the Durham Regional
Official Plan.

comments you may have within 60 days of this request.
If you are unable to respond within this time limit
please advise, in writing, as to the reason for the

SUBJECT
PROPOSED AMENDMENT TO 11-IE DURHAM REGIONAL OFFICIAL PLAN TO PERMIT LIMITED
PERSONAL SERVICE USES IN RESIDENTIAL AREAS.
RECOMMENDATION
THAT the Planning Committee authorize staff to advertise in the appropriate
newspapers that the Planning Committee and Regional Council will be considering
an amendment to the Durham Regional Official Plan in accordance with Appendix I
to Commissioner's Report. No. 80- 280. ,
REPORT
At its meeting of July 9, 1980, Regional Council approved an amendment to the
Durham Regional Official Plan which provided for limited office development and
certain retail uses in Residential Areas subject to the inclusion of appropriate
provisions in the respective District Plan and/or the respective restricted area
(zoning) by-law [File 80-3/D(37)]. This Amendment was prepared in order to
provide more flexibility with respect to the Regional Council policy of
encouraging the development of multi-functional areas. This Amendment was
approved by the Minister of Housing on November 17, 1980.
In the implementation of the. policy with respect to multi-functional areas , it
has become apparent that limited personal service uses would also be appropriate
in such areas at the discretion of the Council of the respective area
municipality.
As indicated in the attached amendment document, it is proposed that the words
and personal service"' be added to Section 8.1.2.1 (c) of the Durham Regional
Official Plan. The proposed amendment is consistent with the intent of Section
7.2.7 of the Durham Regional Official Plan such that the development of
multi-functional areas would be encouraged in order to increase the efficiency of
the use of land.

APPENDIX I TO COMMISSIONER'S REPORT ,(3�
PROPOSED AMENDMENT TO THE DURHAM REGIONAL OFFICIAL PLAN
PURPOSE: The purpose of this Amendment to the Durham Regional Official
Plan is to provide for certain personal service uses in
Residential Areas subject to the inclusion of appropriate
provisions in the respective District Plan and/or the
respective area (zoning) by-law.
BASIS: This Amendment has been prepared in order to provide more
flexibility with respect to the Regional Council policy of
encouraging the development of multi-functional areas.
ACTUAL The Durham. Regional Official Plan is hereby amended by adding
AMENDMENT: the words "and personal service" to the first sentence in
Section 8.1.2.1(c) such that Section 8.1.2.1(0• reads as
fol l ovis:

"8.1.2.1(c) Limited office development and limited retail and
personal service uses may be permitted in
Residential Areas as an exception, subject to the
inclusion of appropriate provisions in the
respective District Plan and/or the respective
restricted area' (zoning) by-law subject that:
i ) the intent of establishing Local Central Areas
as designated in the respective District Plan
in Residential Areas and the function and
character of such Central Areas in accordance
with Section 8.2 is maintained; and
ii) such uses are desirable and compatible with
their surroundings."
IMPLEMENTATION: The provisions set forth in the Durham Regional Official Plan,
as. amended, regarding the implementation of the Plan shall
apply in regard to this Amendment.
INTERPRETATION: The provisions set forth in the Durham Regional Official Plan
as amended, regarding the interpretation of the Plan shall
apply in regard to this Amendment.
